Closely Vetting All 2022 Judicial Candidates Regardless of their Ethnicity is a Must as the Midterm Election Cycle Draws Nearer


Judge Brittanye Morris (above far left) hasn’t even been on the bench for a good month and she’s already in hot water! Was investigative reporter Wayne Dolcefino hired to do a hit-job on this young Black judge? Who cares? The real question here (that everyone should be asking) is why didn’t Judge Brittanye Morris, the newly elected judge for the 333rd Civil District Court formerly held by Judge Daryl Moore recuse herself from a case involving her former client and close friend Ali Choudhri? That’s the big question people should be concerned about with the release of Dolcefino’s very detailed video. Then the next question that should be on everybody’s mind is, “HOW WELL DOES JUDGE BRITTANYE MORRIS UNDERSTAND THE JUDICIAL CANONS?” that governs her activities as a member of the judiciary. For those of you who don’t know, Canon 1 – Talks about how Judge Brittanye Morris and all of her colleagues must always uphold the integrity and independence of the judiciary. Canon 2 – Talks about how Judge Brittanye Morris and all of her colleagues must avoid impropriety and the appearance of impropriety in all of their activities. Canon 3 – Talks about how Judge Brittanye Morris and her colleagues must perform the duties of the judicial office they’re holding by serving the people impartially and diligently. Canon 4 – Talks about how Judge Brittanye Morris and all of her colleagues must conduct their extra-judicial activities to minimize the risk of conflict with their judicial obligations. Canon 5 – Talks about how Judge Brittanye Morris and all of her colleagues must refrain from inappropriate political activity. Canon 6 – Talks about how Judge Brittanye Morris and all of her colleagues must comply with the Code of Judicial Conduct in all of their dealings. Canon 7 – Talks about the effective date of compliance that Judge Brittanye Morris and all of her colleagues should already by familiar with prior to taking the bench. Canon 8 – Talks about the construction and terminology of the code that Judge Brittanye Morris and all of her colleagues should know and fully understand. And that being said, let’s commit ourselves to nominating and then elected the “BEST QUALIFIED CANDIDATES” regardless of their ethnicity, political connections, socio-economic states, or sexual orientation in the 2022 Midterm Elections in Harris County, Texas.

On Monday, December 13, 2021, at 6:00 P.M. there will be more African American candidates signing of to run for re-election in Harris County, Texas than we’ve ever had in the history of elections in our area. That being said, you can bet your bottom dollar that many of the candidates will be facing stiff challenges up and down the ballot. That being said please do not let it come as a surprise when you see Black Democratic judicial candidates draw opponents on December 13, 2021 at the filing deadline. Look, there’s nothing racist about a white, Hispanic, or person from another ethnic group choosing to unseat a Black person who is holding one of the judicial benches or other offices that will be present on the ballot in the 2022 midterms. Again, expect to see stiff challenges up and down the ballot in Harris County, Texas. As a matter of fact, I already know of several Black judges who will more than likely face challenges from members of their own political party – SO GET READY!!!

It's Clear that Veteran Investigative Reporter Wayne Dolcefino Has set His Sights on Judge Brittanye Morris

Look, I know that many of you have already seen the hit-piece put out by veteran investigative reporter Wayne Dolcefino by now. If you have not seen it, I the hit-piece put out by veteran investigative reporter Wayne Dolcefino strongly suggest that you take a look at it by clicking this link right now. While I haven’t fully investigated the claims that Wayne Dolcefino made against Judge Brittanye Morris in the video, I can tell you that, after watching the video and viewing the supportive documents presented by Dolcefino, he appears to have his ducks all lined up in a row – so to speak. However, with that said, it’s also evidently clear that this is a hit-piece and someone definitely hired Wayne Dolcefino to take aim at Judge Brittanye Morris, the presiding judge for the 333rd Civil District Court in Harris County, Texas – which is okay. Did you hear me? There is nothing wrong with people hiring private consultant companies to do opposition research, or conduct investigations into local corruption – which is what Wayne Dolcefino did in the case of Judge Morris.

Judge Brittanye Morris, the presiding judge for the 333rd Civil District Court in Harris County, Texas is one of the youngest sitting judges in America.

RENCENT BIRTHDAY CELEBRATION

Judge Brittanye Morris celebrated her birthday in December of 2020. As a matter of fact, a Facebook post she published stated, “I had an amazing birthday weekend! The best present is the presence of the one you love the most.” And yes, she’s right, but I can guarantee you that if someone hired Wayne Dolcefino to go after Judge Brittanye Morris they aren’t planning to show her no love – not at all. And if Wayne gets his way – Judge Morris is going to have a lot of explaining to do in the very near future. 



Judge Brittanye Morris, the presiding judge for the 333rd Civil District Court in Harris County, Texas is a Muslim. Not that her faith had anything to do with her not recusing herself.

SHE SHOULD HAVE RECUSED 

Judges have to be smart about what they are doing these days. If you are going to error – error on the side of not jeopardizing your future, by stepping away from cases that may be questionable. I get it, attorneys and other people donate to campaigns. And I also totally understand how elected officials (even judges) may feel like their caught between a rock and a hard place at times; but it is evidently clear that in the case that Wayne Dolcefino referenced involving that real estate developer Ali Choudhri should have never went down the way that it did. As a matter of fact, Ali Choudhri has been taking a beating in the local courts as of late – just as Wayne Dolcefino pointed out. So, that being said, the smart thing for Judge Brittanye Morris to do in the case of her former client and close friend – should have been to recuse herself from the case involving Choudhri – altogether to avoid the trouble she’s now facing – which is a story I will deal with later. 



For more than twenty-five years, veteran investigative reporter Wayne Dolcefino has been one of the most feared names in Texas television in the Houston-area. And in case you don’t know, back when he served as head of KTRK TV's national award winning 13 Undercover Unit, Dolcefino exposed public corruption, cover-ups, charity fraud, and the waste of taxpayer money. 

SAY WHAT YOU WANT 

Go ahead and say what you want about Wayne Dolcefino! Go ahead and attack him – if you like! Go ahead and say that he’s out to get Black folk. Say that he has a problem with Black people in positions of authority. Call him a racist if like – but that won’t change the facts that he presented in his video. Say that he doesn’t like “BLACK GIRL MAGIC” and is out to bring Black sista’s down. Let’s say that all of that is true – but at the end of the day in the case of Judge Brittanye Morris, she’s still going to have to answer to some sort of higher-authority for her actions in the case involving her former client, Ali Choudhri and why she ruled in his favor in a case that clearly wasn’t going his way when her predecessor, Judge Daryl Moore was presiding over the case. If you don’t remember, Judge Daryl Moore was unseated by Brittanye Morris back on Tuesday, March 3, 2020, in the Democratic Party primary race for the 333rd Civil District Court bench in Harris County, Texas. As a refresher, Brittanye Morris received 151,780 votes, for an astonishing 61.35% of the vote to unseat Judge Daryl Moore who only received 95,605 votes, for 38.65% of the vote in his losing bid for re-election. 



It isn't difficult to now see exactly why many local Democratic groups and organizations like (HBAD) Houston Black American Democrats will often times endorse the incumbent over their sometimes less-qualified challengers in key local races. 

IMPRESSIVE ENDORSEMENTS 

For those of you who don’t know, Judge Daryl Moore was a very good judge while he served on the bench. This was evident, with the number of local groups and organizations who endorsed him in his bid for re-election back on March 3, 2020, in the Democratic Party primary. But voters seemed to not only ignore his stellar record of accomplishments, they also ignored his very impressive endorsement list as they overwhelmingly cast their votes for the much younger Brittanye Morris – an African American female who now finds herself, after not even a month on the bench – in hot water!!! Did the Democrats who voted for Morris get it wrong or right? And why did they ignore the endorsement recommendations put forth by Judge Moore back on March 3rd? After all, Judge Moore was endorsed by the Houston Chronicle, Area 5 Democrats, Bay Area New Democrats, Greater Heights Democratic Club, Texas Gulf Coast Labor Foundation, AFL-CIO, Houston GLBT Political Caucus, Texas Coalition of Black Democrats – HC, Houston Association of Women Attorneys, Houston Lawyers Association, Houston Black American Democrats, Mexican American Bar Association Houston, Texas Democrats With Disabilities, TransGriot, Tejano Democrats, Houston Muslim Democrats, Baptist Ministers Association of Houston and Vicinity, Victory Fund, and even the Houston Police Officers' Union. 



Local judges like the Honorable Judge Nikita Harmon, 176th Criminal District Court are doing a fine job -- just as Judge Daryl Moore was doing before being unseated back on Tuesday, March 3, 2020, race for District Judge, 333rd Civil District Court, in Harris County, Texas. It isn't difficult to now see exactly why (HBAD) Houston Black American Democrats will often times endorse the incumbent whom they know and trust, over unknown candidates.

A GREAT DISTRICT JUDGE 

It’s clear that identity politics is playing a role in the way voters are casting their ballots in Harris County, Texas and other places across the nation. But it is incumbent upon us to do a better job going forward into the 2022 Midterm Elections. It’s heartbreaking to see good candidates lose election simply because of their ethnicity, or gender. Judge Daryl Moore’s only agenda while on the bench was to rule on cases before him without bias. In fact, the last time I looked at his website I saw this statement still posted, “It's been a privilege to serve the citizens of Harris County as judge of the 333rd Civil District Court. Since elected, I have had a single agenda -- to keep my finger off the scales of justice and to let the parties have their day in court,” said Judge Daryl Moore. He went on to say, “If re-elected, I will continue to do just that, and to make sure that everyone who appears in the 333rd is treated fairly and respectfully.”

A lot of folks were dismayed when Brittanye Morris received 151,780 votes, for an astonishing 61.35% of the vote to unseat Judge Daryl Moore who only received 95,605 votes, for 38.65% of the vote in his losing bid for re-election back on Tuesday, March 3, 2020, in the Democratic Party Primary race for District Judge, 333rd Civil District Court, in Harris County, Texas. 

A HARD-WORKING JUDGE

It doesn’t matter whether you voted for Brittanye Morris, or Judge Daryl Moore back in the March 3, 2020, Democratic Party primary race. If you match these two candidates up against one another on paper, it’s very clear that former Judge Daryl Moore was the better choice. But don’t take my word for it simply take a look at his qualifications. 

* 2019's highest-rated judge of the 84 elected trial-court judges in Harris County (civil, criminal, family, juvenile, and probate courts). www.hba.org (2019 Judicial Questionnaire). 

* Voted 2018's "Trial Judge of the Year" by the Texas Association of Civil Trial and Appellate Specialists (T.A.C.T.A.S.). 

* Received the 2018 "President's Award for Outstanding Service to the Houston Bar Association" for his work for the Harris County Law Library and its award-winning bilingual publication of the Pro Se Litigant's Handbook/Manual para Litigantes Pro Se. 



"The fact that I see Wayne Dolcefino Consulting hiring during the middle of the COVID-19 Pandemic should tell you all that you need to know in terms of how his business is doing. That being said, I think more than a handful of judges should be very concerned right about now."

WAYNE DOLCEFINO IS HIRING 

As soon as I saw the video created by Wayne Dolcefino, the first question that popped into my mind was, “WHO HIRED WAYNE TO DO THIS TO BRITTANYE?” and after watching the video several times, I started to ask myself, “WHY IN THE WORLD DID JUDGE BRITTANYE MORRIS NOT RECUSE HERSELF FROM THIS CASE?” and after that, my phone began to ring off the hook. But look folks, I am going to say this one more time, there is absolutely nothing wrong with Wayne Dolcefino’s private consulting company being hired to opposition research, or investigative reports on judges. However, it is a problem if he’s only going after Black sitting judges – which does not appear to be the case as it relates to Judge Brittanye Morris. In case you don’t know, according to his Facebook page, Wayne Dolcefino has formed a unique private consulting company, combining his decades of investigative and journalistic experience. Dolcefino Consulting provides investigative and media consultation services to those who have experienced injustice. 

CORRUPTION IS REAL

JUDGES HAD BETTER BEHAVE

According to their website, “Our legal system is based on the principle that an independent, fair and competent judiciary will interpret and apply the laws that govern us. The role of the judiciary is central to American concepts of justice and the rule of law. Intrinsic to all sections of this Code of Judicial Conduct are the precepts that judges, individually and collectively, must respect and honor the judicial office as a public trust and strive to enhance and maintain confidence in our legal system. The judge is an arbiter of facts and law for the resolution of disputes and a highly visible symbol of government under the rule of law,” it says. It also goes on to say that, “The Code of Judicial Conduct is not intended as an exhaustive guide for the conduct of judges. They should also be governed in their judicial and personal conduct by general ethical standards. The Code is intended, however, to state basic standards which should govern the conduct of all judges and to provide guidance to assist judges in establishing and maintaining high standards of judicial and personal conduct.”

CONCLUSION 

As it stands right now, I am not sure how far Wayne Dolcefino is going to push this situation. However, all sitting judges – especially African American members of the judiciary should make damn sure that they are doing everything by the book between now and Monday, December 13, 2020. Why? Well, you can best believe that Judge Brittanye Morris isn’t the only judge that’s on Wayne’s list.

EXPERIENCED REPORTER

I would have you to know that not everyone who has been accused of a crime or enters a guilty plea in connection with a crime is guilty of the crime they're accused of committing. Neither is everyone who goes to trial to fight charges that are leveled against them and get's convicted are guilty. Look, over the years, some very bad things have happened to people of color in our criminal justice system. So to this end, please understand, that during my career, I’ve gone into the Harris County Jail and Texas prisons on numerous occasions (on secret assignments) working in conjunction with the owner of one of the largest locally owned private security, and investigations firms. The man who was funding my investigations back then (who mysteriously died) also was the godfather of one of my sons, and the backer of one of my publications. That being said, I can straight-faced assure you that I’ve seen some of the injustices that are occurring in the Texas penal system up close and personal. While on the inside, I interviewed (face-to-face) some of the hardest criminals you can imagine for my research. I also discovered first-hand that many of the people who should be locked up are walking around free, and not all of those who are locked behind bars are guilty of the crimes that they, in some cases pleaded guilty to – for whatever reason. So, let me assure you that I know a criminal when I see one. And we have a handful of local elected officials who are straight-criminals and must be stopped!!!

PEOPLE OVER POLITICS

Based on my direct observations over the years, I can attest to the fact that our current criminal justice system is more about “HAVE’S AND HAVE NOT’S” to a greater degree than most people realize.  That being said, sure, in some cases, the skin color of the person being accused of a crime plays a role in who gets indicted and eventually convicted of crimes and those who go free. However, at the end of the day, from observing the system from the inside, and out; having money, good legal representation and access to influential people are unfortunately key determining factors when it comes to who will spend the rest of their life walking around with an “X” on their back and who doesn’t. So, to this end, we must endeavor to change our criminal justice system and political landscape by “TAKING POLITICS OUT” of the way our judges are selected in the Lone Star State – that’s very important to me!
