The Anti-SLAPP Motion Filed By Downtown Oliver Brown to Protect Judge DaSean Jones Could Be the Perfect Antidote


The smartest move Judge DaSean Jones (Democrat) made was hiring attorney "Downtown" Oliver Brown to defend him against the lawsuit that was filed against him by his Republican challenger by the name of Tami Pierce, who is not claiming that Judge Jones (himself) did anything wrong. Judge Jones's lawyer "Downtown" Oliver Brown may have discovered "THE ANTIDOTE" to shield Judge Jones from the poisonous lawsuit that has been filed against him by Pierce and the former chairman of the Harris County Republican Party who is assisting her with her case. By filing his Anti-SLAPP motion, which is designed to preventTami Pierce, and the former Chairman of the Harris County Republican Party Paul Simpson, from using the courts to intimidate his client (Judge DaSean Jones) who was only exercising his “FIRST AMENDMENT RIGHT” when he ran for office. Judge DaSean Jones, and his beautiful wife Audia Jones, are a picture-perfect depiction of what the "ALL AMERICAN FAMILY" should be during this pivotal moment in the history of our great nation. According to his website, "After witnessing first-hand how many judges were closed-minded and prejudiced towards some defendants and attorneys but afforded others with whom they were socially or financially in line with better opportunities and common courtesies, as well as "the benefit of the doubt," Judge Jones ran for office and won in November of 2018; making him the first minority to preside over the 180th Criminal District Court since its inception."

"A FAMILY MAN."

"After graduating from the storied Tuskegee University, Judge DaSean Jones was commissioned as an Army Field Artillery Officer, where he led soldiers from all walks of life and held the highest standards as a military combat arms officer. Judge Jones, his wife, and his children reside in Houston, Texas where his children attend public school."

Judge Jones is the son of a career Army Non-Commissioned Officer. "As an undergraduate, Judge DaSean Jones attended Tuskegee University where he was active in the Army Reserve Officer Training Corps (ROTC) and a senior member of the National Society of Pershing Rifles—Drill Team. He was raised by his dad, a retired U.S. Army Staff Sergeant, and his mother, who passed away on Valentine's Day a few weeks after his return from his second tour in Iraq," according to his website.

Anti-SLAPP Motion Filed By Downtown Oliver Brown to Protect Judge DaSean Jones Might be the Antidote to the GOP Lawsuits

I'm not exactly sure why some of the other lawyers who are representing the Democrats who are being sued haven't filed Anti-SLAPP motions to protect the "FIRST AMENDMENT RIGHTS" of their clients yet. I mean, each attorney still has time to file their own Anti-SLAPP motions if they a truly working to protect their client's First Amendment Rights. Why haven't they done so already? Who knows; but something doesn't smell right. Anyways, for the record, running for public office in America is the epitome of “FREE SPEECH” as it relates to the First Amendment protections afforded to every American in our United States Constitution.

Now, what I find very concerning with these most of these "GOP LAWSUITS" that were filed against Democrats is the fact that over half of the lawsuits have been filed against Black Democrats, and almost all of the rest of the lawsuits have been filed against "ETHNIC MINORITY" Democrats with the exception of (5) five of the troubling lawsuits. And nope, I'm not trying to place the "RACE CARD" or joking around -- this is a very serious matter that may need (DOJ) Department of Justice intervention at some point along the way.

"TROUBLING FACTS."

I'm very troubled by the fact that over half of the lawsuits filed by Republicans were filed against African American candidates. And what troubles me, even more, is that none of our local media outlets have pointed out this disturbing fact as of the date of this report. Neither the Houston Chronicle, Channel 2, Channel 11, Channel 13, Channel 26, CNN, FOX NEWS, MSNBC, or MAJIC 102, have alerted and made the general public aware of the fact that "ETHNIC MINORITIES" appear to be under attack in nearly every one of the "GOP LAWSUITS" that have been filed in Harris County, Texas.

"RUNNING FOR OFFICE."  

Running for public office in America is the epitome of “FREE SPEECH” as it relates to the First Amendment and exercising your “CONSTITUTIONAL RIGHTS” based on my understanding of the United States Constitution.

Freedom of speech, in case you are unaware, is the bedrock of our democracy. So are, freedom of the press, the right to petition our government, freedom of assembly, and freedom of religion. But our right to “FREEDOM OF SPEECH," is the most sacred of all of our constitutionally protected rights. Why? Well, when it comes to us freely speaking our minds, all of us are protected, or none of us are protected in this great land that we all love and call home.

In case you don't know, when Judge DaSean Jones and Tami Pierce placed their names on the ballot to run for District Judge, for the 180th Criminal District Court, back on Tuesday, November 8, 2022, they were both exercising their right to free speech.

"There are four basic types of speeches. Now, just so you know, the four basic types of speeches are: to inform, to instruct, to entertain, and to persuade. And when a candidate places their name on a ballot to run for public office, they're informing the general public that they want to serve them as an elected official. And then, through running campaigns, these people are trying to persuade the general public who are registered (voters) to cast ballots their vote for their candidacy."

“FREEDOM OF SPEECH” does not stop with the candidates when it comes to politics. The voters themselves are afforded the ability to support, political movements, and candidates as they make their voices heard at the ballot box.

Every legal vote that was cast back on Tuesday, November 8, 2022, in Harris County, Texas was a registered voter exercising their right to "FREE SPEECH" by voicing their opinion, for, or against, a candidate who was present on the ballot in each specific contest.

From what I understand, if Judge David Peeples somehow fails to rule on the Anti-SLAPP motion within the allowed 60-day timeframe, then the parties can automatically appeal. "The strategy I’ve used is being employed to resolve an open question of law that has not been litigated. However, I’m certain that we will see changes to the law from these election contests," says “Downtown” Oliver Brown. 

From what I can see, attorney “Downtown” Oliver Brown, appears to be right. And ultimately, Judge David Peeples or a judge of a higher court is going to without question be forced to agree with Brown's Anti-SLAPP motion.

Judge David Peeples is a very good judge, and he’s very knowledgeable too. However, many other lawyers, and perhaps even a few judges, don’t understand what an Anti-SLAPP motion is all about.

 SLAPP is an acronym that stands for “Strategic Lawsuits Against Public Participation.” And SLAPPs are lawsuits that are filed in many cases to intimidate and silence people from exercising their right to freely speak their minds and exercise their “FIRST AMENDMENT RIGHT” to free speech. 

 When SLAPP lawsuits are filed, a lot of times the plaintiff is trying to force the defendant to cower down or face the consequences of having to fight an expensive legal battle in court.

When an attorney files an Anti-SLAPP motion, like “Downtown” Oliver Brown has done for his client, Judge DaSean Jones (a Democrat), what he’s trying to do is prevent, Tami Pierce, and the former Chairman of the Harris County Republican Party Paul Simpson, from using the courts to intimidate his client (Judge DaSean Jones) who was only exercising his “FIRST AMENDMENT RIGHT” when he ran for office.

So, in essence, attorney “Downtown” Oliver Brown has done the right thing for his client, by filing his Anti-SLAPP motion, on behalf of Judge DaSean Jones. Why? Well, because running for public office is a protected form of speech that is a matter of public concern.

What does a matter of public concern? Well, the United States Supreme Court has already decided numerous cases that involved speech addressing matters of public concern; but I’m not going to get into those right now. However, just so you know, matters of public concern are those, “relating to any matter of political, social, or other concern to the community” or “is subject to legitimated news interests; that is, a subject of general interest and of value and concern to the general public.”

Now, I’m not a lawyer, nor do I ever plan to become one; but “Downtown” Oliver Brown, appears to have placed Tami Pierce, and her lawyer between a rock and a hard place in my opinion.

Attorney Paul Simpson, and Tami Pierce, are facing the daunting task of proving the claims that they’ve alleged in their lawsuit against Judge DaSean Jones.

They, (Paul Simpson and Tami Pierce), have had the burden of proof placed squarely on their shoulders by attorney “Downtown” Oliver Brown and should be compelled by Judge David Peoples to show him that they have evidence that will cause them to prevail in their suit, and achieve a favorable verdict. Which they may have difficulty doing at this time. Thus, if they cannot meet the burden of proof Judge Peeples may be forced to dismiss their claim against Judge DaSean Jones, and order Tami Pierce to pay Judge Jones’s legal fees.

“THE ANTI-SLAPP MOTION.”

As I’ve already said, attorney “Downtown” Oliver Brown filed an Anti-SLAPP motion which requires the Court to address the validity of the election contest within 60 days. If the court fails to rule then the parties can automatically appeal.

Attorney “Downtown” Oliver Brown is also challenging the form of the election contest because Tami Pierce did not attach a proper notice form to her lawsuit. Her attorney (of counsel) Paul Simpson argued this provision does not apply to this specific lawsuit, but attorney Brown disagreed.

Yesterday, the Court heard oral arguments in the Pierce versus Jones case. For the record, “Downtown” Oliver Brown argued that Judge DaSean Jones’s constitutional rights of freedom of speech and freedom of association are implicated by Tami Pierce’s lawsuit.

Pierce is arguing that the Anti-SLAPP statute does not apply to an election contest. So, as it stands right now, Judge David Peeples will have to decide this issue. However, from what I can see, the strategy being used deployed by Brown is a new one and may have to ultimately be decided by the Court of Appeals and the Texas Supreme Court, if “Downtown” Oliver Brown’s Anti-SLAPP motion is denied by Judge Peoples.

“Downtown” Oliver Brown also argued that Tami Pierce has not presented any real evidence of fraud, mistake, or illegality on behalf of his client. As for Paul Simpson, he argued that he only needs to assert a prima facie case to survive the Anti-SLAPP motion filed on behalf of Judge Jones, by attorney Brown.

"NUMBERS DON'T LIE."

There were a total of (64) sixty-four down-ballot countywide races that could have been contested in Harris County, Texas as it relates to the "VOTER SUPRESSION" and the lack of paper ballots are a concern. Of the (64) sixty-four down-ballot countywide races, Republicans won (4) four of the races by defeating four African American Democratic judicial nominees. 

So why didn't Judge Ronnisha Bowman (African American female Democrat), Porscha Natasha Brown (African American female Democrat), Je'Rell Rogers (African American male Democrat), or Gemayel Haynes (African American male Democrat) sue to contest their election losses. Well, that's a story for another day. But the fact that Porscha Natasha Brown, a candidate who only lost by 267 votes, didn't sue the Republican who defeated her, is understandable. How? Well, if Porsha Natastha Brown had made a stink about her loss to Lesley Johnson, it could have exposed the fact that Porscha Natasha Brown should not have been allowed to appear on the ballot in the first place, because of a residency issue.


Alexandra del Moral Mealer, a Republican Latino female is suing Harris County Judge Lina Hidalgo who also happens to be a Democrat Latino Female, to overturn the race for Harris County Judge.


Nile Copeland, a White Republican male is suing Judge Latosha Lewis Payne who is an African American Democrat female, to overturn the race for District Judge, 55th Civil District Court.


Tami Pierce, a White Republican female is suing Judge DaSean Jones who is an African American Democrat male, to overturn the race for District Judge, 180th Criminal District Court.


Erin Lunceford, a White Republican female, is suing Judge Tamika "Tami" Craft, an African American Democrat female, to overturn the race for District Judge, 189th Civil District Court.


Bruce Bain, a White Republican male is suing Judge Cory Sepolio who is a Hispanic Democrat male, to overturn the race for District Judge, 269th Civil District Court.


Michelle Fraga, a Latino Republican female, is suing Judge Christine Weems, an American-born South Asian Democrat female, to overturn the race for District Judge, 281st Civil District Court.


Elizabeth Buss, a White Republican female is suing Judge David Fleischer who is a White Democrat male, to overturn the race for Judge, County Criminal Court at Law No. 5.


Mark Montgomery, a White Republican male is suing Judge Kelley Andrews who is a White Democrat female, to overturn the race for Judge, County Criminal Court at Law No. 6.


Mark Golberg, a White Republican male is suing Judge Erika Ramirez who is a Latino Democrat female, to overturn the race for Judge, County Criminal Court at Law No. 8.

has a surname that is used by people who are Dutch, Indian, Turkish, or Polish. Sartaj Bal is the Republican male who is suing Judge Toria Finch who is an African American Democrat Democrat female, to overturn the race for Judge, County Criminal Court at Law No. 9.


Dan Spjut, a White Republican male is suing Judge Juanita Jackson who is an African American Democrat female, to overturn the race for Judge, County Criminal Court at Law No. 10.


Dan Simons, a White Republican male is suing Judge Sedrick Walker who is an African American Democrat male, to overturn the race for Judge, County Criminal Court at Law No. 11.


Matthew Dexter, a White Republican male is suing Judge Genesis Draper who is an African American Democrat female, to overturn the race for Judge, County Criminal Court at Law No. 12.


James Lombardino, a White Republican male is suing Judge Audrie Lawton who is an African American Democrat female, to overturn the race for Judge, County Civil Court at Law No. 1.


Aaron Adams, an African American Republican male is suing Judge LaShawn Williams who is an African American Democrat female, to overturn the race for Judge, County Civil Court at Law No. 3.


Brian Staley, a White Republican male is suing Judge Monica Singh who is a Democrat female of Indian-Origin, to overturn the race for Judge, County Civil Court at Law No. 4.


Rory Olsen, a White Republican male is suing Judge Jason Cox who is a White Democrat male, to overturn the race for Judge, County Probate Court No. 3.


Will Archer, a White Republican male is suing Judge James Horwitz. In case you don't know, Horwitz is a surname, current among Ashkenazi Jews. Archer is suing Judge Horwitz to overturn the race for Harris County Probate Court No. 4.


Chris Daniel, a White Republican male is suing District Clerk Marilyn Burgess who is a White Democrat female, to overturn the race for Harris County District Clerk.


Stan Stanart, a White Republican male is suing County Clerk Teneshia Hudspeth who is an African American Democrat female, to overturn the race for Harris County Clerk.


Kyle Scott, a White Republican male is suing County Treasurer Carla Wyatt who is an African American Democrat female, to overturn the race for Harris County Treasurer.

"TIME TO WAKE UP."

The time has come for local community leaders and public officials to wake up and start paying closer attention to these “ELECTION CONTESTS” that are being presided over by Judge David Peeples, on Thursdays, via Zoom.

In case you're wondering, my assessment of Judge David Peeples’ work so far is that this Republican judge appears to be making a ‘good-faith effort’ in his quest to get things right and follow the law. Especially so, when it comes to the case involving Tami Pierce (Republican), versus Judge DaSean Jones (Democrat), who currently serves as the presiding judge for the 180th Criminal District Court in Harris County, Texas. 

Judge DaSean Jones’s lawyer, “Downtown” Oliver Brown has filed an Anti-SLAPP motion that requires the Court to address the validity of the election contest that has been filed against his client (Judge DaSean Jones) by Tami Pierce within 60 days.

Senior Judge 
Retired from 224th District Court, San Antonio 

Judge David Peeples served as judge of Bexar County’s 285th District Court (1981-1988), as justice of the Fourth Court of Appeals (1988-1994), and as judge of the 224th District Court (1995-2004). Since retiring from the active trial bench in 2004, he has sat by assignment and served as an arbitrator. In October 2017 he became of counsel to Prichard Young LLP in San Antonio. He continues to arbitrate and take occasional assignments as a visiting judge. From 1996 to 2017 he was the Presiding Judge of the Fourth Administrative Judicial Region of Texas, and from 2003 to 2017 he chaired the Texas Multi-District Litigation Panel. He has been a member of the Texas Supreme Court’s Advisory Committee on Rules since 1993. He received the Texas Bar Foundation’s Outstanding Jurist Award in 2007 and the State Bar Judicial Section’s Lifetime Achievement Award in 2016. Judge Peeples received his B.A. from Austin College, an M.A. in Government from the University of Texas, and his J.D. from the University of Texas, where he was a note and comment editor on the law review.

Ryan MacLeod is a partner at the law firm Kherkher Garcia, LLP, and appears to have developed a stellar reputation as a fierce trial lawyer according to their website. Attorney Ryan MacLeod has uncovered according to the court proceedings that took place, appears to have uncovered a “TREASURE TROVE” of communications that could eventually pose a serious problem for attorney Andy Taylor, and the Harris County Republican Party very soon.

"THE AGREEMENT."


Odus Evbagharu, the chairman of the Harris County Democratic Party, has already done the right thing and tendered his resignation effective February 28, 2023. As for Harris County Republican Party Chairman Cindy Siegel, she has not announced her resignation as of Tuesday, February 7, 2023. That being said, if Conservatives can get Cindy Siegel to agree to take a "LIE DETECTOR TEST" the citizens of Harris County, Texas could get a better understanding as it pertains to the 'alleged' agreement that was forged between Cindy Siegel, Odus Evbagharu, and others during the 2022 Midterm Election cycle. Remember, Harris County Judge Lina Hidalgo, Don Hooper (Republican Precinct Chair for (Precinct #16), and Rachel Hooper, legal counsel for the Republican Party of Texas have already spilled the beans. 

"WHITE SUPREMACIST?"


Genevieve Carter currently serves as the communications director for the Harris County Republican Party. But she also appears to have the desire to spread her "RACIST TENTACLES" into other areas as a consultant during the upcoming 2024 Presidential Election cycle. Until she was exposed last week, she was 'openly' acting as the "ADMINISTRATOR & MODERATOR" for a private FACEBOOK group called, "The New Harris County Republican Party Executive Committee," which appears to be a breeding ground for "WHITE SUPREMACY" and a place where people like Don Hooper, a local drunk, and surrogate for Harris County District Attorney Kim Ogg, has slithered, squirmed, and maneuvered his way into playing a leadership role. A WHITE SUPREMACIST is a person who believes that white people constitute a superior race and should therefore dominate society, typically to the exclusion or detriment of other racial and ethnic groups.

Rachel Hooper and Don Hooper are surrogates for Harris County District Attorney Kim Ogg, who is a Democrat. The Hoopers played a significant role in helping District Attorney Kim Ogg to run her candidates from the right and left side of the political aisle back during the Tuesday, March 1, 2022, Democrat Party Primary and the Tuesday, March 1, 2022, Republican Party Primary. And Rachel Hooper, acting in her position as legal counsel from the Republican Party of Texas appears to have been instrumental in securing the funding for the "GOP CANDIDATES" who filed lawsuits against the mostly "ETHNIC MINORITY" Democrats who are being sued to have their elections overturned in Harris County, Texas.
