Judge DaSean Jones Hires Downtown Oliver Brown to fend off the Lawsuit Filed Against Him by Tami Pierce, and Paul Simpson

As you may, or may not know, the first lawsuit that was filed against a Democrat following the Tuesday, November 8, 2022, Midterm Election was thrown by Dade Phelan, the Speaker of the House of Representatives for the state of Texas. That particular lawsuit that was filed by “GOP” candidate Mike May, against state Representative Jon Rosenthal, was thrown out because Mike May, failed to pay the filing costs as required under Texas Law.
Now, there are many more “GOP” candidates pushing for new elections, or to be declared the winner of races they lost in Harris County, Texas back on Tuesday, November 8, 2022, in the Midterm Election.
"My client should not bear any responsibility for errors, if any, made by Election Administrator Clifford Tatum," says attorney “DOWNTOWN” Oliver Brown, who has been hired by Judge DeSean Jones to help him fend off the lawsuit that has been brought against him.
According to “DOWNTOWN” Oliver Brown, "The law that this suit has been filed under needs to be updated and mandate that the County pay the attorney fees of the contestee," he said, speaking of his client Judge DaSean Jones who is listed as the “CONTESTEE” in the lawsuit.
"Essentially, as the law stands, if the county makes a mistake it is left to the candidates to fight it out in court at their own expense,” he went on to explain. "The threat of facing a lawsuit will certainly decrease the number of citizens that are willing to serve in public office."
If you ask me, “DOWNTOWN” Oliver Brown is right. There are a bunch of potential candidates for the 2024 Presidential cycle who are out there waiting to see how these lawsuits end up. As for “DOWNTOWN” Oliver Brown, and Judge DaSean Jones, they are remaining hopeful and prayerful.
"We are hopeful and prayerful that this lawsuit ends shortly so Judge Jones can focus on serving our community," said “DOWNTOWN” Oliver Brown, in our phone interview.
“THE ANSWER.”
As stated in his answer, to Tami Pierce’s lawsuit, “Judge Jones hereby denies each and every allegation contained in the plaintiff/contestant’s Petition. Judge Jones specifically denies that the plaintiff/contestant is entitled to any relief whatsoever and demands strict proof of each and every allegation,” says “DOWNTOWN” Oliver Brown.
On (PAGE ONE), “DOWNTOWN” Oliver Brown states, Judge Jones, objects to this election contest due to the Contestant failing to strictly comply with TEX. ELEC. CODE § 232.008 and §232.009. A contestant must deliver, electronically or otherwise, a copy of the petition to the secretary of state by the same deadline prescribed for the filing of the petition. TEX. ELEC. CODE §232.008 (d). Judge Jones demands strict proof of compliance with this section. If the contestant did not send notice to the Texas Secretary of State, this matter must be dismissed for failing to comply in a timely manner.”
On (PAGE TWO), “DOWNTOWN” Oliver Brown goes on to explain, “Additionally, the canvas authority must receive notice if a general election will be necessary if the contestant prevails. TEX. ELEC. CODE §232.009 (a). In order to effectuate this notice, a contestant “must attach to the petition a statement informing the clerk that the notice is required and containing the name and address of each person to whom the notice is required to be delivered.” TEX. ELEC. CODE §232.009 (d) (emphasis added).”
Also, on (PAGE TWO), “DOWNTOWN” Oliver Brown points out says, “Here, the contestant has not provided the required notice and has failed to include a necessary party, the Election Administrator, who is directly responsible for allegations in Pierce’s petition. If Tatum is excluded, then Judge Jones, an innocent party, will have to bear the cost of defending Harris County's actions related to the 2022 General Election.”
In a very clever move, “DOWNTOWN” Oliver Brown introduces the “TEXAS CITIZENS PARTICIPATION ACTION MOTION” that’s better known as the (Anti-SLAPP Motion), which stands for “Strategic Lawsuit Against Public Participation.”
So, what “DOWNTOWN” Oliver Brown, just did, by filing his “ANTI-SLAP MOTION” to dismiss was ask the court to promptly end the lawsuit against Judge DaSean Jones, the presiding judge for the 180th Criminal District Court, because the lawsuit filed by Tami Pierce, violates the Texas Citizens Participation Act.
With this particular filing, by “DOWNTOWN” Oliver Brown, it is highly likely that Tami C. Pierce could end up paying the attorney’s fees incurred by Judge DaSean Jones if the dismissal is granted. And that’s exactly what “DOWNTOWN” Oliver Brown expects to happen.
In his prayer, on (PAGE EIGHT) of his answer, “DOWNTOWN” Oliver Brown states, “Therefore, Judge Jones requests that the Court grant this motion, sign an order dismissing Plaintiff’s claims with prejudice, and award Judge Jones attorney’s fees and sanctions against Plaintiff to prevent similar conduct in the future. It is further requested that the Court hold a hearing on this motion within the next 30 days.
Between now, and the next 30 days, I guess all we can do is wait and see, what the judge overseeing the lawsuit has to say about “DOWNTOWN” Oliver Brown, and his clever move.
