The Lawsuit Filed By GOP Candidate Erin Lunceford Against Judge Tamika Craft Will Go to Trial on Monday, June 12, 2023


Judge David Peeples (center), the visiting judge overseeing "THE ELECTION CHALLENGE" in the case of Erin Elizabeth Lunceford (left) versus Judge Tamika Craft has set the trial date for Monday, June 12, 2023. When you get right down to this case, Judge David Peeples will not be able to ascertain what the true results should have been. Why? Well, the numbers don't add up. For the record, (16) sixteen of the down-ballot local countywide races have "BALLOTS CAST TOTALS" that equal a total of 1,107,390 ballots cast. Now, the race for the 189th Civil District Court, between Lunceford and Craft matches up perfectly with 1,107,390 ballots cast total certified by the Harris County Elections Administrator (Clifford Tatum) when you add the Votes Cast, Undervotes, and Overvotes together. However, serious errors in the 6,115 canvass report make it impossible for anyone to ascertain the true results of any countywide race that appeared on the ballot on Tuesday, November 8, 2022, in Harris County, Texas.



Under section 232.041 of the Texas Election Code, Judge David Peeples, the visiting judge overseeing “THE ELECTION CHALLENGE” filed by Erin Elizabeth Lunceford against Tamika Craft may not have any choice but to void the Tuesday, November 8, 2022, race for Judge, 189th Civil District Court, that took place in Harris County, Texas.

 "TRUE RESULTS."

The true results of the 189th Civil District Court election between Erin Elizabeth Lunceford, and Tamika Craft cannot be ascertained by anyone – including Judge David Peeples. That being said, when the outcome of an election as depicted in the “OFFICIAL CUMULATIVE REPORT” is not the true outcome because of errors and mistakes as we see in the Harris County Elections Administrator’s report released by Clifford Tatum, the election must be voided under Texas Law. Sec. 232.041. NEW ELECTION ORDERED IF CONTESTED ELECTION VOID. In an election contest in which the contested election is declared void, the court shall include an order directing the appropriate authority to order a new election in its judgment.

"CLEAN V. DIRTY."

If you look at the "CLEAN CUMULATIVE REPORT" that was made official in Tarrant County, Texas by Republican County Officials, and compare it to the "DIRTY CUMULATIVE REPORT" that was made official in Harris County, Texas by Democratic County Officials it will become evidently clear that something criminal (not a human error) occurred in Harris County, Texas back on Tuesday, November 8, 2022, in the Midterm Election.

Judge David Peeples served as judge of Bexar County’s 285th District Court (1981-1988), as justice of the Fourth Court of Appeals (1988-1994), and as judge of the 224th District Court (1995-2004). Since retiring from the active trial bench in 2004, he has sat by assignment and served as an arbitrator. In October 2017 he became of counsel to Prichard Young LLP in San Antonio. He continues to arbitrate and take occasional assignments as a visiting judge. From 1996 to 2017 he was the Presiding Judge of the Fourth Administrative Judicial Region of Texas, and from 2003 to 2017 he chaired the Texas Multi-District Litigation Panel. He has been a member of the Texas Supreme Court’s Advisory Committee on Rules since 1993. He received the Texas Bar Foundation’s Outstanding Jurist Award in 2007 and the State Bar Judicial Section’s Lifetime Achievement Award in 2016. Judge Peeples received his B.A. from Austin College, an M.A. in Government from the University of Texas, and his J.D. from the University of Texas, where he was a note and comment editor on the law review.

The Harris County Elections Administrator (Clifford Tatum) produced an error-filled "OFFICIAL CUMULATIVE REPORT" that appears to show criminality, not human error, or incompetence. "INVESTIGATION."

The results of our 6-month investigation conclude that with the exception of the race for Judge, 180th Criminal District Court between Tami Pierce (Republican), and Judge DaSean Jones which is currently on appeal, all of the remaining races should be voided by Judge David Peeples when they go to trial.

If you ask me, the true results of the 189th Civil District Court election between Erin Elizabeth Lunceford, and Tamika Craft cannot be ascertained by anyone – including Judge David Peeples. That being said, when the outcome of an election as depicted in the “OFFICIAL CUMULATIVE REPORT” is not the true outcome because of error, mistakes, or fraud like we may have just witnessed unfold in Harris County, Texas, the election must be voided under Texas Law. Sec. 232.041. NEW ELECTION ORDERED IF CONTESTED ELECTION VOID. In an election contest in which the contested election is declared void, the court shall include an order directing the appropriate authority to order a new election in its judgment.

In reality, attorney Andy Taylor does not really have to prove that number of Republican voters who got turned away and disenfranchised on Tuesday, November 8, 2022, exceeds Judge Tamike Craft's margin of victory that's reported as being 2,743 votes. Attorney Andy Taylor isn't trying to have his client declared the winner, but rather, what he's saying is that because of the egregious errors, mistakes, and possible fraud that occurred, Judge David Peeples should order a new election for his client, Erin Elizabeth Luncefored, and he's correct.

What attorney Andy Taylor has to show Judge David Peoples is that there were votes that got counted that should not have been counted. And there were votes that should have been counted, but did not get counted. And the gravy on the top of attorney Taylor's plate is that he has documented proof that people who wanted to vote were not able to do so because of possible criminal acts, or human error on Tuesday, November 8, 2023, in Harris County, Texas.

"CRIMINALITY."

Unlike Tarrant County, which is run by Republicans, the third largest county in America (Harris County) is run by Democrats. And based on the “OFFICIAL CUMULATIVE REPORT” that was produced by Harris County Elections Administrator Clifford Tatum, the numbers produced appear to be the result of malfeasance of some sort on behalf of a human being – not computer error or incompetence.

If you "CLICK HERE" and look at the first (16) sixteen local down-ballot countywide races for Harris County, what you will find is that all (16) sixteen have the same combined total of “1,107,390” when you add their Cast Votes, Undervotes, and Over votes together.

The first (16) sixteen local down-ballot countywide races for Harris County, Texas started off with the race for District Judge, 55th Civil District Court, between Nile Copeland (Republican), and Judge Latosha Lewis Payne (Democrat) who was running for reelection and ends with the race for District Judge, 234th Judicial District Court between Michael West (Republican), and Judge Lauren Reeder (Democrat) who was running for reelection.

“CRAZY NUMBERS.”

Please understand that the first (16) sixteen local down-ballot countywide races all produce the same total of “1,107,390” when their Cast Votes, Undervotes, and Overvotes are added together. However, the numbers went a little crazy after the race for District Judge, 234th Judicial District Court between Michael West (Republican), and Judge Lauren Reeder (Democrat) who was running for reelection.

After the previous (35) thirty-five local down-ballot countywide races had produced the same number of “1,107,127” the next (5) five races all produced different totals when their Cast Votes, Undervotes, and Overvotes were added together.

***The race for Judge, County Probate Court No. 4 produced a number totaling “1,106,252” when the Cast Votes, Undervotes, and Overvotes were added together for this countywide race.

***The race for Harris County District Clerk produced a number totaling “1,106,252” when the Cast Votes, Undervotes, and Overvotes were added together for this countywide race.

“THE CONCLUSION.”

According to the Texas Election Code, only a judge can void an election and order a new one. That being said, I just don’t see how Judge David Peeples could look objectively at this “ERROR-FILLED CUMULATIVE REPORT” and go through all (6,115 – PAGES) of the “OFFICIAL CANVASS REPORT” and see that every countywide race included an incorrect voter percentage of 789.62% for “PRECINCT 1086” and not come to the conclusion that it’s impossible to ascertain the true results of any countywide race that took place back on Tuesday, November 8, 2022, in the Midterm Election.

I believe that attorney Elizabeth D. Alverez is correct when she stated, in every one of her lawsuits that, “If the Court cannot because of fraud or mistake, or because an election official engaged in activity that prevented eligible voters from voting, be certain that the outcome as posted in the final canvas represents the true outcome, and cannot ascertain the true outcome of the election, it must declare the election void, and order a new one.”

According to the "OFFICIAL CANVASS REPORT" that was released by Harris County Elections Administrator Clifford Tatum, back on November 19, 2022, there are only (318) registered voters living in (PRECINCT #1086), which is a Republican stronghold. So, how did Erin Elizabeth Lunceford supposedly receive 1,911 votes in this precinct, and Tamika "Tami" Craft reportedly receive 517 votes, if there are only (318) registered voters in the precinct? 


Are the turnout numbers reported by the Harris County Elections Administrator Clifford Tatum of Precinct #1086 accurate? How do we know that Erin Elizabeth Lunceford really received 1,911 votes in this precinct? And how do we know that Tamika "Tami" Craft only received 517 votes in this precinct? Remember, according to the "OFFICIAL CANVASS REPORT" released by the Harris County Elections Administrator (Clifford Tatum), there are only 318 registered voters in Precinct #1086, which is a newly created Republican stronghold in Katy, Texas. You can "CLICK HERE" to see the error for yourself.


It is impossible to achieve a voter turnout percentage greater than 100%, like the Harris County Elections Administrator Clifford Tatum reported for Precinct #1086, in his "OFFICIAL CANVASS REPORT" that was certified by County Commissioner Rodney Ellis, and County Commissioner Adrian Garcia, back on February 22, 2022, in Harris County, Texas. You can "CLICK HERE" to see the error for yourself.


The tell-tale sign that something went desperately wrong on Tuesday, November 8, 2022, in Harris County, Texas is the fact that the “BALLOTS CAST TOTAL” of 1,107,390, that was reported by Harris County Elections Administrator (Clifford Tatum) only matches up with (16) sixteen local down-ballot countywide races.

The (16) sixteen local down-ballot countywide races that match the 1,107,390, “BALLOTS CAST TOTAL” released by Harris County Elections Administrator (Clifford Tatum) are the races for the following DISTRICT COURTS: 55, 113, 157, 180, 182, 183, 184, 184, 189, 190, 208, 209, 228, 230, 232, and 234, according to my investigation of the “OFFICIAL CUMULATIVE REPORTS” by Tatum.

We also discovered that the (4) four HARRIS COUNTY PROBATE COURT races, 1, 2, 3, and 4 “DO NOT” have combined totals that match the 1,107,390, “BALLOTS CAST TOTAL” released by Harris County Elections Administrator (Clifford Tatum) for the Tuesday, November 8, 2022, Midterm Election.
