Judges Must Be Carefully Selected; Voters Should Look for Fair, Competent, Unbiased Judges in 2022 Midterms Says Local Activist


Judge Israel Garcia (left) was just elected to serve as Justice of the Peace for Precinct 5, Place 1, back on Tuesday, November 3, 2020. Judge LaShawn A. Williams is one of the “BLACK GIRL MAGIC” judges up for re-election in the 2022 Midterm Election who has come under fire for a recent eviction she ordered. And she’s not the only one, please see, “Houston-area Judges Are Evicting Renters Who Could Be Protected under Federal Order” that was published by Houston Public Media. Now, Judge Garcia, a Democrat, made a lot of promises when he was running for office. And he’s done a fine job since unseating Judge Russ Ridgway, a Republican to take over the Precinct 3, Place 1 bench. However, one of the boldest moves he’s made since taking the bench was to “PAUSE EVICTIONS” in his courtroom. Yes, you heard me right – Judge Israel Garcia put a pause on evictions when he took the bench. In case you don’t know Judge Garcia, he’s a fair, tough, smart, competent, well-liked judge and compassionate. Now, there’s two sides to every story, but if you believe community activist, Arthur J. Smith, local Democrats may have some difficult decisions to make in their upcoming Tuesday, March 1, 2022, Democratic Party Primary. “She automatically took the plaintiff’s side in court. Judge LaShawn A. Williams violated her “Oath of Office” 28 U.S. Code 453-Oath of Justices and Judges by not doing equal right to me (the poor) by stating to me, "I don't care if you have to sleep in a shoe box!" This was stated to me by her during a Pandemic/National Disaster/State of Emergency,” he says.

For the record, I really like Judge LaShawn A. Williams, presiding judge for Harris County Civil Court at Law No. 3. I am going to repeat that for those of you who are way in the back – I LIKE JUDGE LASHAWN A. WILLIAMS!!! However, after sitting down and listening to the story that was brought to me by Arthur J. Smith “ART”and his wife Koffey, I am kind of puzzled. I mean, I have known “ART” and his wife Koffey for nearly 30-years. That being said, I’ve only known Judge LaShawn A. Williams, for a short time. Actually, I met Judge LaShawn A. Williams back during the historic 2018 Midterm Elections, when the whole “Black Girl Magic” thing to Harris County by storm. That being said, you can kind of understand how this is one of the toughest reports I’ve ever had to write. Why? Well, on one hand I have a “DULY-QUALIFIED” Black female Judge (LaShawn A. Williams), who has done business with me, and supports my vision. On her website Judge LaShawn A. Williams states, “My career has been rich and diverse, representing the interests of many on both sides of the aisle. This strong professional experience allows me to have the understanding and genuine perspective needed to respect wholly each party before me, and to interpret, honor and uphold the letter and spirit of the law.”

Judge Jim Kovach a Democrat, will be up for re-election in the 2022 Midterm Election in the race for County Civil Court at Law No. 2 in Harris County. Judge LaShawn Williams, will be up for re-election in the 2022 Midterm Election. The deadline to file for a place on the 2022 Midterm ballot is Monday, December 13, 2021. She will be up for re-election in the race for County Civil Court at Law No. 3 in Harris County, Texas.


Arthur J. Smith claims that Judge LaShawn A. Williams told him, "I don't care if you have to sleep in a shoe box" during a court proceeding in her courtroom.

NO STRAIGHT-TICKET VOTING

In the “EXCLUSIVE INTERVIEW” I plan to release next week, I asked Arthur J. Smith a series of questions about his experience with Judge LaShawn A. Williams and Judge Jim Kovach to get a better understanding of why he has become so angry Judge LaShawn A. Williams. There’s definitely bad-blood between Judge LaShawn A. Williams and Arthur J. Smith, that’s defiantly going to spill over into the 2022 Midterm Election cycle. That being said, candidates planning to run for office in 2022 must make a concerted effort to run for office on the own merit in the upcoming Tuesday, March 1, 2022, Democratic Party Primary. Now, there’s nothing wrong with judge supporting one another, but straight-ticket voting is dead and gone in Texas. And at the end of the day, every candidate in every 2022 Democratic Party Primary race will be responsible for convincing voters to cast their ballot specifically for them.

AUBREY R. TAYLOR: What should voters be looking for when trying to decide what type of judges should be nominated when they go to vote on Tuesday, March 1, 2022, in Harris County?

ARTHUR J. SMITH: “When trying to decide what types of judges should be elected when going to vote on Tuesday, March 1, 2022, in Harris County, people should look for individuals that have a proven track record of having high moral character when it comes to being a servant for all people. Look for someone who is Competent, Fair, Not Bias, and who will not just talk the talk, but who will walk the walk to make a positive difference for all mankind. Someone who will operate according to their “Oath Of Office” on behalf of the people and not commit “Abuse Of Power” with their position, and will not exercise misconduct by committing violations, crimes and neglecting policies and procedures due to them being controlled by outside influences. Harris County voters should cast their ballot for candidates who will serve for the people, not just people who know how to campaign well. They should look for candidates who will be a Public Servant for the people and not a Private Servant for themselves.”

AUBREY R. TAYLOR: What are your thoughts about Judge Jim Kovach? I understand that you recently had to appear in his courtroom.

ARTHUR J. SMITH: “My thoughts about Judge Jim F. Kovach are that he's a Competent, Non-Bias and a Fair Judge after viewing my Exhibit (Evidence) and evaluating the verbal testimonies from both parties (Plaintiff, Robert C. Williams, his Attorney, Ernie Garcia and the Defendant, Arthur Smith, myself) and making a FINAL TAKE NOTHING JUDGEMENT IN FAVOR OF DEFENDANT for Case No. 1159848 (206100194844) during a Zoom Trial Setting in Harris County Civil Court At Law No. 2 where he's the presiding judge.”

AUBREY R. TAYLOR: What are your thoughts about Judge LaShawn A. Williams? I understand that you had to appear in her courtroom recently.

ARTHUR J. SMITH: “My thoughts about Judge LaShawn A. Williams are that she's Incompetent, Bias and a Unfair Judge after refusing to view my Exhibit (Evidence) that she allotted me more time to submit. Then placing the burden of proof upon me to take a copy of my Exhibit that I had, out of my pocket and then reading it out loud in court in person, which she demanded me to appear because my phone only could do audio zoom. And with that and all the other unethical behavior she showed towards me, she made a FINAL JUDGEMENT IN FAVOR OF PLAINTIFF for Case No. 1159831 (206100194842) during a Zoom Re-Set Trial Setting in Harris County Civil Court At Law No. 3 where she is the presiding judge. And she did all of this without even reviewing any Exhibit (Evidence) from the plaintiff or his attorney that 5311 Sonora Street, Houston, Texas 77020 exists and that he is the rightful deed property owner of property for 5311 Sonora Street, Houston, Texas 77020. Judge LaShawn A. Williams is a bad judge."

AUBREY R. TAYLOR: Is there a difference between how you were handled in Judge Kovach's Courtroom when compared to the way you were treated in Judge LaShawn Williams' Courtroom?

ARTHUR J. SMITH: “Yes. There was a big difference between how I was treated in Judge Kovach’s Courtroom when compared to the way I was treated in Judge Williams’ Courtroom. Judge Kovach did not make me feel rushed at any time during trial. Judge Kovach actually took the time to view and evaluate the evidence I submitted. And he Judge Kovach actually listened to both parties’ statements during the court proceeding before rendering a final judgment in my case.

Judge LaShawn Williams made me feel rushed during trial. She did not view or evaluate the evidence I submitted to her court. She did not listen to both parties’ statements during the court proceeding. And her ruling was bias in my opinion.

She automatically took the plaintiff’s side in court. Judge LaShawn A. Williams violated her “Oath of Office” 28 U.S. Code 453-Oath of Justices and Judges by not doing equal right to me (the poor) by stating to me, "I don't care if you have to sleep in a shoe box!" This was stated to me by her during a Pandemic/National Disaster/State of Emergency. I felt emotionally distressed to hear that coming from a judge towards me. She should be aware that I'm Indigent because within my case that's presented on the docket for the court where she presides as judge, proves that I am Indigent. And judges must be equal (fair) to the rich and the poor. Not impartial. She acted as a Trespasser of the Law by not following the law. She abused her position of power by being unjustifiably rude, hostile, unfairly critical and abusive towards me by making a statement in reference to my character to the plaintiff attorney by saying, "I don't think he will damage the property in a week’s time." Assassinating my character and falsely accusing me of being capable of vandalizing property. I couldn't believe it. That was so unethical and she committed so much Judicial Misconduct towards me and in reference to the case. Judge Williams violated her obligations as a judge of impartial conduct."

"This is a sad situation all the way around. So, I truly hope that this fight between Arthur J. Smith, his family, and Judge LaShawn A. Williams does not spill over into the 2022 Midterm Election cycle. It's heartbreaking to hear that more than 13,000 evictions have been filed since the CDC moratorium was issued. And more than 24,000 evictions have been filed in the Houston-area since this pandemic began. We really need to focus our attention on electing firm, yet compassionate Judges who follow the law to the bench in the 2022 Midterms in Harris County, Texas."

Nominating the Wrong Candidates on "SUPER TUESDAY" Could Have Disastrous Consequences in the November 2022 General Election in Harris County

Make no mistake about it, who the people of Harris County, Texas chooses to give another term to in 2022 must be about substance, job performance, judicial temperament, competence, and whether or not our members of the judiciary are following the law with their rulings. And that being said, in 2022, it is incumbent upon the voters of Harris County to evaluate the job performance of each and every sitting "ELECTED OFFICIAL" on a case-by-case basis and not as a group based on their political party affiliation, ethnicity or gender.

However, though she did not have an opponent, 135,959 Democratic Party Primary voters still cast their vote for her to be the Democratic nominee. However, though he did not have an opponent, 128,120 Democratic Party Primary voters still cast their vote for him to be the Democratic nominee. That being said, when the Tuesday, November 6, 2018, general election rolled around, he beat his Republican opponent by 157,129 votes in Harris County, Texas.

However, though she did not have an opponent, 131,958 Democratic Party Primary voters still cast their vote for her to be the Democratic nominee. That being said, when the Tuesday, November 6, 2018, general election rolled around, she got the fewest number of votes of any Democratic candidate who was running in a countywide race in Harris County, Texas. So, for the record, the general election race for Harris County Judge ended up being a race between Lina Hidalgo (Democrat), Ed Emmett (the sitting Republican Harris County Judge at the time) and a Libertarian candidate by the name of Eric Gatlin. What you have to remember about the race for Harris County Judge back in 2018, is that straight-ticket voting was allowed back then. And due to straight-ticket voting, Lina Hidalgo enjoyed a 105,158 straight-ticket voting advantage over Ed Emmett. And having a Libertarian candidate in the race who receive 24,634 votes was a huge factor that contributed greatly to helping Lina Hidalgo unseat Ed Emmett by 19,277 votes – which was the smallest margin of victory of any Democrat running countywide on the ballot back on Tuesday, November 6, 2018, in the general election.

Judge Briones soundly defeated former Judge William “Bill” McLeod back on Tuesday, March 3, 2020, when he tried to reclaim the seat he accidently resigned from by announcing his candidacy to run for higher office only a short time after he had taken the bench. And when the Tuesday, November 3, 2020, general election rolled around, Judge Lesley Briones put on a dominant performance against Clyde Raymond Leuchtag, the former Republican judge, who lost his seat to William “Bill” McLeod back during the Tuesday, November 6, 2018, general election. All of that being said, Judge Lesley Briones has done an outstanding job since taking the bench and with the shortage of Latina judges in Harris County, Texas, she should be allowed to through the 2022 Midterm Election, nomination process unchallenged. There’s absolutely no reason for any Democrat to challenge Judge Lesley Briones on Tuesday, March 1, 2022, in the Democratic Party Primary.


*** Judge Genesis E. Draper is the Presiding Judge, for Harris County Criminal Court-At-Law No. 12. She was appointed to this bench by Harris County Commissioner Rodney Ellis and his fellow Democrats on Commissioner’s Court after the untimely death of Judge Cassandra Hollemon. Based on her dismal showing in the Tuesday, November 3, 2020, general election, she could draw several challengers in the Tuesday, March 1, 2022, Democratic Party Primary -- and rightfully so. In fact, Judge Draper may be one of the most vulnerable Democrat judges on the entire Tuesday, March 1, 2022, Democratic Primary ballot. How can I say this? Well, back on Tuesday, November 3, 2020, in the presidential election, while her fellow Democratic comrades where handily defeating their Republican rivals, Judge Genesis Draper allowed her Republican challenger, former Judge Linda Garcia to beat her in the Election Day turnout category. She performed very poorly against former Judge Linda Garcia who happened to be a Latina female. So, if there's a “DULY-QUALIFIED” Latina lawyer out there who is looking for a seat to challenge in 2022 – Harris County Criminal Court-At-Law No. 12 just might be your best chance. And in my opinion, the right Latina (Democratic) female attorney should be able to take this bench away from Judge Genesis Draper on Tuesday, March 1, 2022, in the Democratic Party Primary. But don't take my word for it -- the numbers don't lie! Back on Election Day, former Judge Linda Garcia (Republican) received 95,628 votes, for 51.49% of the Election Day voter turnout. Comparatively speaking, Judge Genesis Draper (Democrat) only received 90,090 votes, for 48.51% of the Election Day voter turnout. So, while Judge Genesis Draper did go on to win her race (primarily because of her Democratic Party affiliation) she did so by the smallest margin of victory when compared to the other Democrats who were running for a local judicial bench on the Tuesday, November 3, 2020, presidential election ballot.
