Attorney Steve Kherkher Files Answer for Judge Tamika “Tami” Craft; Erin Elizabeth Lunceford is Seeking a New Election



Attorney Steven Kherkher's answer to the lawsuit that was filed by former Judge Erin Elizabeth Lunceford (right) against his client, Judge Tamika "Tami" Craft, stated, “There is literally not a shred of proof that a single one of the allegations, or even all of the allegations coupled together, would have changed the outcome." However, the judge hearing their case might see things a little differently when he's presented with evidence that only (16) sixteen of the down-ballot local countywide races have "BALLOTS CAST TOTALS" that equal the correct total of 1,107,390 ballots cast. Now, I do find it interesting that the race for the 189th Civil District Court, where his client (Tamika "Tami" Craft) appeared on the ballot, matches up perfectly with 1,107,390 ballots cast total when you add the Votes Cast, Undervotes, and Overvotes together.


Only (16) sixteen of the (64) sixty-four down-ballot local countywide races have totals that equal the "BALLOTS CAST TOTAL" that was released in the "OFFICIAL CUMULATIVE REPORT" and certified by "Democrat" County Commissioner Rodney Ellis (Precinct One), and "Democrat" County Commissioner Adrian Garcia (Precinct Two), back on November 22, 2022, in Harris County, Texas. That being said, every countywide race that appeared on the ballot after the race for District Judge, 234th Civil District Court has an incorrect "BALLOTS CAST TOTAL" that was certified by Ellis and Garcia.

Attorney Andy Taylor filed a lawsuit on behalf of former Judge Erin Elizabeth Lunceford, against Tamika "Tami" Craft who was certified as the winner of the race for District Judge, 189th Civil District Court. The first lawsuit that was filed against the current crop of Democratic Party judges in Harris County, Texas was filed back on December 7, 2022, and was filed on behalf of Erin Elizabeth Lunceford, a former judge, by Andy Taylor, who also represents the Harris County Republican Party.

Judge Tamika Tami Craft has hired Kherkher Garcia, LLP, which was founded by Steve Kherkher to defend her against the lawsuit and help her retain her bench. Now, it’s very interesting the newly elected Judge Tamika Tami Craft decided to hire attorney Steve Kherker to fend off the lawsuit, being that he doesn’t really handle very many “ELECTION LAW” cases judging from information about him online.

From what I can see, according to the website for Kherkher Garcia’s website, Steve Kherker does have 30+ years of experience, but most of his experience seems to be in the area of complex tort litigation – not Election Law. In fact, according to his website, Steven Kherkher has successfully represented Plaintiffs in over 40 states in a variety of complex civil litigation matters. I

Kherkher’s expertise appears to be in the areas of catastrophic personal injury, wrongful death, commercial automobile and trucking accidents, product liability, toxic torts, premises liability, as well as lawsuits against multi-national pharmaceutical companies. If you notice, you don’t see, “ELECTION LAW” listed among his specialty areas of practice.

Now, I get it, Steve Kherker is a top-notch lawyer, and he’s well respected by judges, opposing counsel, and his fellow colleagues, according to his website. But how is that really going to help Tamika “Tami” Craft, defend herself in the lawsuit that’s being brought against her by attorney Andy Taylor, on behalf of Erin Elizabeth Lunceford?

According to her lawsuit, what Erin Elizabeth Lunceford is after, appears to be a new election for the 189th Judicial District Court. However, Lunceford’s reasoning behind her request for a new election appears to be focused more on Clifford Tatum botching the Tuesday, November 8, 2022, Midterm Election, than Tamika “Tami” Craft, cheating to gain an unfair advantage or anything of the sort.

So, why isn’t Erin Elizabeth Lunceford, and her attorney Andy Taylor, going after the County, and the Democratic Party, rather than Tamika “Tami” Craft who really didn’t do anything to her “GOP” opponent, Erin Elizabeth Lunceford?

“Contestant does not accuse Contestee of any wrongdoing, but is required under the Texas Election Code to name Contestee as the defendant in an election contest,” is what point (4) four, on (PAGE 2) of Lunceford’s lawsuit explains.

Attorney Steve Kherkher’s answer to the lawsuit that was filed against Tamika “Tami” Craft, pretty much was nothing more than a general denial of the allegations brought forward by Erin Elizabeth Lunceford, and her attorney Andy Taylor.

“This lawsuit is not about an election. This lawsuit is not even about Contestant or Contestee. Instead, this lawsuit is about Contestant’s counsel, who is also the lawyer for the Harris County Republican Party, incessant need to challenge our democracy,” said Kherkher on (PAGE ONE), of his answer.

Kherkher also tore into the recent election audit that was conducted by the Forensic Audit Division of the Texas Secretary of State’s Office stating, “And this election audit—because we should call it what it is—is just another stunt to make headlines after an election was lost.”

According to Kherkher, own words, “After November 8, 2022, Contestant’s counsel seized on the opportunity to earn money at the expense of Harris County taxpayers.” He also uses a quote that was reportedly published in Texas Monthly that referred to attorney Andy Taylor as nothing more than a troubleshooting lawyer for Republicans whose political problems become legal problems.

As proof, on (PAGE THREE) of his lawsuit, Kherkher explains, “Coincidentally, here, Contestant is a Republican lawyer who lost a political election. And now, Contestant’s lawyer has seized on the opportunity to file this frivolous election contest that is not about Contestee or who won the election. Instead, Contestant’s counsel blatantly told the media exactly what the lawsuit is about during a Harris County GOP news conference. During that conference to announce this election contest, Contestant’s Counsel stated that “he wanted to use the lawsuit to send a message to Harris County elections administrator Clifford Tatum.”

Also, on (PAGE THREE) Kherkher goes on to explain, “Notably, no evidence was attached to Contestant’s Original Petition. No mention was made of 2,734 fraudulent votes. No mention was made of wrongdoing by Contestee.”

“Instead, Contestant’s Original Petition is a politically fueled lawsuit riddled with unsupported allegations,” said attorney Steve Kherkher.

“There is literally not a shred of proof that a single one of the allegations, or even all of the allegations coupled together, would have changed the outcome," he proclaimed. 

“It’s a where there is smoke, there is fire approach. But we remain with bated breath to see the fire and the reckoning,” said attorney Steve Kherkher.

FLAWED CANVASS REPORTS

I totally understand where attorney Steve Kherkher is coming from in his defense of newly elected judge Tamika “Tami” Craft in his quest to help her remain the presiding judge for the 189th Civil District Court. But Kherkher and a whole host of local officials are wrong about their assertion that there wasn’t any possible wrongdoing in Harris County, Texas, back on Tuesday, November 8, 2022, in the Midterm Election.

To prove my point, I’m going to stick straight to the facts. And that being said, where there is smoke, you can rest assured that there’s a fire somewhere.

We’re sitting here right now with an “ERROR-FILLED CANVASS REPORT” and everyone seems to be ignoring this fact. Is this some sort of cover-up, or something? If you ask me, the election was totally botched by Clifford Tatum, on the reporting of the results for PRECINCT #1086, calls all (6,115 PAGES) of his error-filled canvass report.

Listen, it’s impossible to have a turnout percentage greater than 100%, in any mathematical equation. So, the fact that Clifford Tatum reported that there was a 789.62% voter turnout in PRECINCT #1086, is a whole lot of smoke.



According to the "OFFICIAL CANVASS REPORT" that was released by Harris County Elections Administrator Clifford Tatum, back on November 19, 2022, there are only (318) registered voters living in (PRECINCT #1086), which is a Republican stronghold. So, how did Erin Elizabeth Lunceford supposedly receive 1,911 votes in this precinct, and Tamika "Tami" Craft reportedly receive 517 votes, if there are only (318) registered voters in the precinct? 


Are the turnout numbers reported by the Harris County Elections Administrator Clifford Tatum of Precinct #1086 accurate? How do we know that Erin Elizabeth Lunceford really received 1,911 votes in this precinct? And how do we know that Tamika "Tami" Craft only received 517 votes in this precinct? Remember, according to the "OFFICIAL CANVASS REPORT" released by the Harris County Elections Administrator (Clifford Tatum), there are only 318 registered voters in Precinct #1086, which is a newly created Republican stronghold in Katy, Texas. You can "CLICK HERE" to see the error for yourself.


It is impossible to achieve a voter turnout percentage greater than 100%, like the Harris County Elections Administrator Clifford Tatum reported for Precinct #1086, in his "OFFICIAL CANVASS REPORT" that was certified by County Commissioner Rodney Ellis, and County Commissioner Adrian Garcia, back on February 22, 2022, in Harris County, Texas. You can "CLICK HERE" to see the error for yourself.


The tell-tale sign that something went desperately wrong on Tuesday, November 8, 2022, in Harris County, Texas is the fact that the “BALLOTS CAST TOTAL” of 1,107,390, that was reported by Harris County Elections Administrator (Clifford Tatum) only matches up with (16) sixteen local down-ballot countywide races.

The (16) sixteen local down-ballot countywide races that match the 1,107,390, “BALLOTS CAST TOTAL” released by Harris County Elections Administrator (Clifford Tatum) are the races for the following DISTRICT COURTS: 55, 113, 157, 180, 182, 183, 184, 184, 189, 190, 208, 209, 228, 230, 232, and 234, according to my investigation of the “OFFICIAL CUMULATIVE REPORTS” by Tatum.

During my investigation into the “OFFICIAL CUMULATIVE REPORTS” released by Harris County Elections Administrator (Clifford Tatum) my investigative team and I, discovered (48) forty-eight local down-ballot races the “DO NOT MATCH” the “BALLOTS CAST TOTAL” certified by Harris County Commissioner Rodney Ellis (Precinct One), and Harris County Commissioner Adrian Garcia (Precinct Two), back on November 22, 2022, without Lina Hidalgo present.

The local down-ballot races that “DO NOT” have combined totals that match the 1,107,390, “BALLOTS CAST TOTAL” released by Harris County Elections Administrator (Clifford Tatum) are the races are the following DISTRICT COURTS 245, 246, 247, 248, 257, 262,263, 269, 270, 280, 281, 295, 308, 309, 310, 311, 312, 313, 314, 315, and 482 according to my investigation.

The race for COUNTY JUDGE between “Democrat” Harris County Judge Lina Hidalgo and her “Republican” challenger Alexandra del Moral Mealer “DOES NOT MATCH” match the 1,107,390, “BALLOTS CAST TOTAL” released by Harris County Elections Administrator (Clifford Tatum) for the Tuesday, November 8, 2022, Midterm Election.

My investigative team also discovered that the (4) four COUNTY CIVIL COURT AT LAW races, 1, 2, 3, and 4 “DO NOT” have combined totals that match the 1,107,390, “BALLOTS CAST TOTAL” released by Harris County Elections Administrator (Clifford Tatum) for the Tuesday, November 8, 2022, Midterm Election.

While investigating the “OFFICIAL CUMULATIVE REPORTS” my team and I also discovered that the (15) fifteen HARRIS COUNTY CRIMINAL COURT AT LAW races, 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, and 15 “DO NOT” have combined totals that match the 1,107,390, “BALLOTS CAST TOTAL” released by Harris County Elections Administrator (Clifford Tatum) for the Tuesday, November 8, 2022, Midterm Election.

We also discovered that the (4) four HARRIS COUNTY PROBATE COURT races, 1, 2, 3, and 4 “DO NOT” have combined totals that match the 1,107,390, “BALLOTS CAST TOTAL” released by Harris County Elections Administrator (Clifford Tatum) for the Tuesday, November 8, 2022, Midterm Election.

The race for HARRIS COUNTY CLERK, between “Republican” Stan Stanart, and current “Democrat” Harris County Clerk Teneshia Hudspeth, was botched. For the record, their combined “BALLOTS CAST TOTAL” did not match the 1,107,390, “BALLOTS CAST TOTAL” released by Harris County Elections Administrator (Clifford Tatum) for the Tuesday, November 8, 2022, Midterm Election.

As for the race for DISTRICT CLERK, between “Republican” Chris Daniel, and current “Democrat” District Clerk Marilyn Burgess, it was botched. Their combined “BALLOTS CAST TOTAL” did not match the 1,107,390, “BALLOTS CAST TOTAL” released by Harris County Elections Administrator (Clifford Tatum) for the Tuesday, November 8, 2022, Midterm Election.

The race for COUNTY TREASURER between, “Republican” Kyle Scott, and “Democrat” Dr. Carla Wyatt, was also botched. Their combined “BALLOTS CAST TOTAL” did not match the 1,107,390, “BALLOTS CAST TOTAL” released by Harris County Elections Administrator (Clifford Tatum) for the Tuesday, November 8, 2022, Midterm Election.

Now, just so you know, when the “TABULATION COMPUTER” added the total number of “CAST VOTES” to the Undervotes, and Overvotes, the “BALLOTS CAST TOTAL” for every down-ballot countywide races should be the same. That being said, In the case of Harris County, Texas, only the first (16) sixteen down-ballot local races matched the 1,107,390, “BALLOTS CAST TOTAL” released by Harris County Elections Administrator (Clifford Tatum) for the Tuesday, November 8, 2022, Midterm Election.
