However, his wife, Colleen M. Vera, is expected to stand tall in the absence of her late husband. After his untimely death, 2 bills were named to honor Alan D. Vera, during the 88th Texas Legislative Session. For the record, SB1070, and SB1933 were both passed in honor of Alan D. Vera and are called the "Alan Vera Election Accountability Act of 2023." In case you don't know, SB1933 lets the Texas Secretary of State step in if a county severely screws up an election.

In my professional opinion, after reviewing all 6115 pages of the "OFFICIAL CANVASS REPORT" for Harris County, Texas, the Tuesday, November 8, 2022, Midterm Election should have never been certified. For the record, nobody, not even Judge David Peeples can ascertain (determine) what the true results of the Tuesday, November 8, 2022, Midterm Election should have been.

Harris County Commissioner Rodney Ellis (Democrat), and Harris County Commissioner Adrian Garcia (Democrat), had a serious lapse in judgment when they voted to certify the "OFFICIAL CANVASS REPORT" that was littered with errors, mistakes, and possible criminal manipulation of the return numbers back on Tuesday, November 22, 2022, in Harris County, Texas.

I've carefully studied the report published by Colleen M. Vera, back on Monday, December 19, 2022, and her work is solid. "The Numbers Don't Add Up," clearly details why the Tuesday, November 8, 2022, Midterm Election should have never, under any circumstances been certified.

If you ask me, Harris County Elections Administrator Clifford Tatum, not showing up for his scheduled deposition back on Friday, June 23, 2023, speaks volumes. Tatum was supposed to be deposed by Attorney Elizabeth Alvarez, at 10:30 a.m., but was a no-show, according to a certificate of non-appearance that has been entered into the court record.

"TAKE IT OVER."

After Colleen M. Vera is done testifying, every open-minded American will be able to see, why Harris County, Texas elections could get taken over by the Texas Secretary of State prior to the upcoming 2024 Presidential Election, and rightfully so.

Summary of Ms. Vera’s Anticipated Testimony:

There are more BBMs counted than are Transmittal Forms.

This witness will testify that the records from Harris County show 2,159 more Ballot by Mail (“BBMs”) were counted than are accounted for on the transmittal forms from EVBB to the Harris County Election Administrator (“HCEA”), which means those BBMs are in the count but should not be. We have produced a spreadsheet which tallies all of the Ballot by Mail transmittal forms. (The first entry is more likely a #5 Provisional Ballot which was transmitted using the wrong form. We included it in the spreadsheet, but then subtracted the number on the last page). We have also produced all of the Transmittal Forms.

The grand total of Accepted BBM Carrier Envelopes from these forms is 59,106 - 1 (#5 provisional) = 59,105.

The final, official cumulative report shows that Harris County counted 61,264 ballots.
That is a difference of 2,159 BBM ballots counted which do not show up on the transmittal forms. This witness will testify that transmittals are required in order to ensure accuracy and chain of custody, and the fact that there are more BBM ballots in the canvassed total than were actually approved for counting by the EVBB is a very serious concern as to whether the canvassed BBM total is inaccurate, as well as whether HCEA ultimately counted BBMs that had been rejected by the EVBB. To ensure that Contestant Lunceford possessed a copy of all of the transmittal documents, a subpoena was issued to HCEA for all such forms, and a copy of all transmittal forms possessed by Contestant was attached as an exhibit. Concurrently with the service of that subpoena, Contestant suggested that HCEA need not produce a duplicate copy of what Contestant already had, unless it was just easier for it to do so, but it was also made clear that the purpose of the subpoena was to obtain copies of any transmittal forms not already in the possession of Contestant and not already attached to the subpoena. In response, HCEA did not produce any additional transmittal documents to show ballots approved by EVBB and sent to the EA staff to be opened and counted, which means that there are no additional forms. The only transmittal forms produced by HCEA were transmittal forms from the HCEA staff to the EVBB, which is not the same thing. These produced forms do not demonstrate what ballots were approved for counting by EVBB, but only demonstrate what ballots were received by the EVBB for their consideration. The crucial point here is that there are BBMs which were accepted and counted that should not have been.

There are more votes in the canvassed totals than the actual number of Voters who voted.
Colleen Vera will testify that at a particular EV poll, SRD 140, which is known as the Hardy Street Senior Citizens Center, they had sixty (60) more ballots to scan than the number of voters who registered to vote at that poll. The documents which demonstrate her analysis are being produced contemporaneously herein. She captured that there were 60 ballots in the emergency chute which would exceed the number of people who checked in. Given that specific discrepancy, she decided to compare the roster for that specific polling center to the final total for that poll on the EV Report. She then compared the totals of BBM, EV and ED for all three rosters to the canvass totals. An analysis of this work is being produced contemporaneously herein to the Court and to opposing counsel.

Colleen Vera has compared the Harris County Official Voter Roster to the Official Canvass for the November 8, 2022 election. She will testify that in her review she discovered that the number of voters from the Official Voter Roster for early voting in person is 692,049 voters while the number of votes on the Early Voting Report generated the last day of early voting shows that there are 692,478 votes, which is 429 more votes than voters. She will also point out that the official canvass for early voting presents 692,748 votes which is 699 more votes than voters. The number of votes for early voting grew by 270 votes after early voting ended. There are other anomalies that Colleen Vera may point out including that the number of Voters on the Unofficial Voter Roster dropped by 269 voters for the Official Voter Roster for Early Voting.


Other topics:

Colleen Vera will also testify as to her personal involvement with the review of PBAs, and will also talk about the problems associated with scanning ballots, how such problems might involve spoiling a ballot and/or placing a ballot in the emergency chute, how the scanning equipment at Central Count is superior to the scanning equipment at a polling location, how ballots in the emergency chute are scanned and/or duplicated with others present, how at least sixty (60) ballots more than actual voters occurred at a polling center, meaning that spoiled ballots were being duplicated, and how issuing an additional ballot would inevitably lead to voters voting twice. Other topics include the cast vote records (“CVRs”), and how they do not match up with some of the races on the ballot, how she received the final reconciliation of the vote on November 18, 2022, but somehow a new final reconciliation appeared on November 19, 2022, and how the reconciliation reports changed over time.

Colleen Vera will also testify regarding the discrepancies in the total count for county-wide candidates on the final canvass. All county-wide candidates should have the same number of votes cast in their races, but not all the county-wide races have the same number of cast votes record.

Senior Judge 
Retired from 224th District Court, San Antonio 

Judge David Peeples served as judge of Bexar County’s 285th District Court (1981-1988), as justice of the Fourth Court of Appeals (1988-1994), and as judge of the 224th District Court (1995-2004). Since retiring from the active trial bench in 2004, he has sat by assignment and served as an arbitrator. In October 2017 he became of counsel to Prichard Young LLP in San Antonio. He continues to arbitrate and take occasional assignments as a visiting judge. From 1996 to 2017 he was the Presiding Judge of the Fourth Administrative Judicial Region of Texas, and from 2003 to 2017 he chaired the Texas Multi-District Litigation Panel. He has been a member of the Texas Supreme Court’s Advisory Committee on Rules since 1993. He received the Texas Bar Foundation’s Outstanding Jurist Award in 2007 and the State Bar Judicial Section’s Lifetime Achievement Award in 2016. Judge Peeples received his B.A. from Austin College, an M.A. in Government from the University of Texas, and his J.D. from the University of Texas, where he was a note and comment editor on the law review.
