Attempt by the Harris County District Attorney's Office to Indict Damien Thaddeus Jones on Felony Charges Was Rejected


The attempt by the Harris County District Attorney's Office to get Democratic Political Consultant Damien Thaddeus Jones into felony court was rejected by Judge Amy Martin, the presiding judge for the 263rd Criminal District Court. In case you don't know, the Honorable Judge Amy Martin, after reviewing the indictments against Damien Thaddeus Jones concluded that, "Upon review of the indictment delivered to this Court in the above-captioned cause, the Court finds that the offense alleged in that indictment is a misdemeanor which does not involve official misconduct or official oppression, and that the Court therefore lacks jurisdiction to conduct further proceedings in this case."

Attempt to Get Democratic Political Consultant Damien Jones into Felony Court Failed

I am sure that many of you don't know that initially the Harris County District Attorney's Office tried to get Democratic political consultant Damien Jones into the 263rd District Court -- which is a felony court. However, thanks to Judge Amy Martin, who is a great judge, after reviewing the indictments against Damien Thaddeus Jones, she stated, "Upon review of the indictment delivered to this Court in the above-captioned cause, the Court finds that the offense alleged in that indictment is a misdemeanor which does not involve official misconduct or official oppression, and that the Court therefore lacks jurisdiction to conduct further proceedings in this case." This honorable judge, who also happens to be a Democrat, went on to say, "It is therefore ORDERED that the indictment presented to this Court in the above-captioned cause be transferred to a county criminal court at law pursuant to articles 21.26 and 21.28 of the Texas Code of Criminal Procedure, and assigned to a particular county criminal court at law under a new cause number in keeping with the local rules and general orders of the Harris County criminal courts."

THE CASE AGAINST DAMIEN

So, after all of the hype with the press conference, as it related to Democratic political consultant Damien Jones, nobody told you that the Harris County District Attorney Office's attempt to get him a felony failed -- right? Remember this, "Democratic political consultant Damien Jones was indicted for Coercion of a Public Servant and False Caller Identification Information Display for an anonymous threat texted to then State Representative Gina Calanni in an attempt to coerce her into resigning her position in HD 132, instead of running for re-election. The threat was made on Dec. 2, 2019 just days before the 2020 election filing deadline. Instead of resigning, Calanni reported the threat to the Texas Rangers, who in conjunction with the Harris County District Attorney’s Office Public Corruption Division, investigated the complaint. If convicted of the two Class A misdemeanors, Jones faces up to a year in the Harris County Jail and up to a $4000 fine or both." Now, whether Damien did the things he's alleged of doing -- I don't know! However, I am a little concerned about the fact that his two cases have made their way into Judge Genesis Drapers -- Harris County Criminal Court at Law No. 12. And thus, I implore ever organization who is a proponent of criminal justice reform to pay close attention to how she handle this case. Why? Well, this particular judge was hand-picked by Harris County Commissioner Rodney Ellis to hold this bench, after the untimely death of the late Judge Cassandra Hollemon -- who was a part of the whole "BLACK GIRL MAGIC" thing back during the 2018 Midterm Election cycle. Again, I am not going to go into it too much right now -- but a bunch of eyes need to be following Democratic political consultant Damien Jones' case as it plays out in Harris County Criminal Court at Law No. 12. And heck, if I was Damien's lawyers, no way, no how, would I want this "RODNEY ELLIS -- APPOINTEE" (Judge Genesis Draper) handling any case involving anyone opposing the Ellis or the Harris County Democratic Party -- I'm just saying! Anyways, I will clearly layout, why criminal justice reform advocates should pay close attention to Judge Genesis Drapers handling of these two misdemeanor cases next week.

I would have you to know that not everyone who has been accused of a crime or enters a guilty plea in connection with a crime is guilty of the crime they're accused of committing. Neither is everyone who goes to trial to fight charges that are leveled against them and get's convicted are guilty. Look, over the years, some very bad things have happened to people of color in our criminal justice system. So to this end, please understand, that during my career, I’ve gone into the Harris County Jail and Texas prisons on numerous occasions (on secret assignments) working in conjunction with the owner of one of the largest locally owned private security, and investigations firms. The man who was funding my investigations back then (who mysteriously died) also was the godfather of one of my sons, and the backer of one of my publications. That being said, I can straight-faced assure you that I’ve seen some of the injustices that are occurring in the Texas penal system up close and personal. While on the inside, I interviewed (face-to-face) some of the hardest criminals you can imagine for my research. I also discovered first-hand that many of the people who should be locked up are walking around free, and not all of those who are locked behind bars are guilty of the crimes that they, in some cases pleaded guilty to – for whatever reason. So, let me assure you that I know a criminal when I see one. And we have a handful of local elected officials who are straight-criminals and must be stopped!!!

PEOPLE OVER POLITICS

Based on my direct observations over the years, I can attest to the fact that our current criminal justice system is more about “HAVE’S AND HAVE NOT’S” to a greater degree than most people realize.  That being said, sure, in some cases, the skin color of the person being accused of a crime plays a role in who gets indicted and eventually convicted of crimes and those who go free. However, at the end of the day, from observing the system from the inside, and out; having money, good legal representation and access to influential people are unfortunately key determining factors when it comes to who will spend the rest of their life walking around with an “X” on their back and who doesn’t. So, to this end, we must endeavor to change our criminal justice system and political landscape by “TAKING POLITICS OUT” of the way our judges are selected in the Lone Star State – that’s very important to me!
