The Stage is Set for a 2020 Democratic Primary Showdown Between Judge Briones and William "Bill" McLeod; Leuchtag Awaits the Winner

In case for some reason you don’t know Judge Briones, she’s the presiding judge for County Civil Court at Law No. 4 in Harris County, Texas. Judge Briones is being challenged by fellow Democrat William “Bill” McLeod (above top right), on Tuesday, March 3, 2020, in the Democratic primary. The winner of the “2020 DEMOCRATIC PRIMARY SHOWDOWN” between Judge Lesley Briones, and “Bill” will have to face off against former Republican Judge Clyde Raymond Leuchtag (above bottom right), next fall in the general election. That being said, Democrats must make sure to nominate the “BEST-QUALIFIED CANDIDATE” who is best suited to hold on to the County Civil Court at Law No. 4 bench against a strong Republican opponent like former Judge Clyde Raymond Leuchtag – without the benefit of straight-ticket voting.

On Tuesday, March 3, 2020, Democrats and Republicans will be selecting their nominees in Harris County, Texas. That being said, one potential nominee on the Democratic side will undoubtedly garner more attention than most. Does the name William “Bill” McLeod sound familiar? Yes, I am talking about, the one-and-only William “Bill” McLeod, the former Democratic judge who accidentally resigned from his bench shortly after winning it, because he didn’t know about (or understand) the resign-to-run law. Now, don't get me wrong, “Bill” is a very likable guy. Hey, a lot of folk love William “Bill” McLeod, but whether he’s the right person for Democrats in Harris County, Texas to nominate to face off against former Judge Clyde Raymond Leuchtag is something else altogether different. Especially when Democrats have a “DULY-QUALIFIED” option like Judge Lesley Briones on the ballot. And hey, if you take a moment to talk to folks around the civil courthouse, what you’re going to hear, is that Judge Lesley Briones has done a tremendous job since being placed on the bench by Harris County Commissioners in the wake of “Bill” triggering his own resignation. Look, the resign-to-run law is pretty easy to understand. Article 16, Section 65(b) of the Constitution of Texas states: "If any of the officers named herein shall announce their candidacy, or shall, in fact, become a candidate, in any General, Special or Primary Election, for any office of profit or trust under the laws of this State or the United States other than the office then held, at any time when the unexpired term of the office then held shall exceed one year and 30 days, such announcement or such candidacy shall constitute an automatic resignation of the office then held, and the vacancy thereby created shall be filled pursuant to law in the same manner as other vacancies for such office are filled." What offices are they talking about? I’m glad you asked. The "officers named herein" are listed in Article 16, Section 65(a): District Clerks, County Clerks, County Judges, Judges of the County Courts at Law, Judges of the County Criminal Courts, Judges of the County Probate Courts, Judges of the County Domestic Relations Courts, County Treasurers, Criminal District Attorneys, County Surveyors, County Commissioners, Justices of the Peace, Sheriffs, Assessors, and Collectors of Taxes, District Attorneys, County Attorneys, Public Weighers, and Constables.


The first day that you can apply for a ballot by mail using Application for a Ballot by Mail (ABBM) or Federal Postcard Application is Wednesday, January 1, 2020. The last day that you can get registered to vote is on Monday, February 3, 2020. Early voting will begin on Tuesday, February 18, 2020. The last day that you can apply for a ballot by mail (received, not postmarked) is Friday, February 21, 2020. The last day of early voting is Friday, February 28, 2020. If you don't vote during the early voting period you can still vote on Tuesday, March 3, 2020, at any open polling location.


Former Judge William "Bill" McLeod is seeking to reclaim the bench he resigned from, shortly after being elected to it. So, on Tuesday, March 3, 2020, in the Democratic primary he will be trying to unseat Judge Lesley Briones in the race for Judge, County Civil Court at Law No. 4, in Harris County, Texas.

WHY ARE WE HERE?

The County Civil Court at Law No. 4 bench isn’t supposed to be on the ballot until the 2022 Midterm Election. However, shortly after being elected to the bench back in 2018, William “Bill” McLeod decided for some reason that he wanted to run for higher office. What office? Rather than serving out his term as the presiding judge for the Harris County Civil Court at Law No. 4, William “Bill” Mcleod decided that he wanted to run for the Texas Supreme Court in 2020. So, he made his intention to run for higher office public in several different ways, thus triggering his automatic resignation from the Harris County Civil Court at Law No. 4 bench he held at the time. Following, his automatic resignation from the bench, Harris County Commissioners, rather than allowing him to serve as a place-holder for the bench decided by way of a public vote to select Judge Lesley Briones to replace William “Bill” McLeod. So, well within his rights to do so, former Judge William “Bill” McLeod has decided to challenge the Honorable Judge Lesley Briones on Tuesday, March 3, 2020, in the Democratic primary race for Judge, County Civil Court at Law No. 4 in Harris County, Texas.


Judge Lesley Briones is highly respected by her fellow colleagues and the attorneys who practice before her. Democratic primary voters are encouraged to consider that attorneys are the ones who are interacting with local judges on a day-in and day-out basis. That being said, it is only fair to point out that 53.4% of the attorneys who responded to the “2019 JUDICIAL EVALUATION QUESTIONNAIRE” gave Judge Lesley Briones an “EXCELLENT” overall rating. And as for her Democratic primary challenger, William “Bill” McLeod, due to triggering his own resignation, he did not remain on the bench long enough to have his name included on the questionnaire for consideration.

STRENGTH OF CANDIDACIES

Yes, William “Bill” McLeod won the 2018 Midterm Election race for the Harris County Civil Court at Law No. 4 bench back on Tuesday, November 6, 2018, when straight-ticket voting was allowed. However, so did every other Democratic candidate who was running for a countywide position in Harris County, Texas back in 2018. Look, every Democrat who was running for a countywide position enjoyed a 105,158 straight-ticket voting advantage over their Republican counterparts. However, straight-ticket voting will not be allowed on Tuesday, November 3, 2020, when the Democratic nominee, whether it be Judge Lesley Briones or William “Bill” McLeod must face off against former Judge Clyde Raymond Leuchtag next fall. So, yes, William “Bill” McLeod was able to win the Harris County Civil Court at Law No. 4 bench back in 2018, over Sophia Mafrige, the Republican. But going up against former Judge Clyde Raymond Leuchtag is something different altogether. Why? Former Judge Clyde Raymond Leuchtag is very respected as a member of the judiciary. In case you don’t know, former Judge Clyde Raymond Leuchtag is considered by many folks from both sides of the aisle to be one the strongest African American judicial candidates the Republican Party has to offer. So, it’s clear the Harris County Republican Party has their sights set on this bench. That being said, Harris County Democrats had better nominate the strongest candidate, and not allow their emotions to get the better of them on Tuesday, March 3, 2020. Look, I’m going to stop short of trying to tell Democrats what to do in the “2020 DEMOCRATIC SHOWDOWN” for the Harris County Civil Court at Law No. 4 race between Judge Lesley Briones, and former Judge William “Bill” McLeod at this time. However, I would encourage all “HARRIS COUNTY DEMOCRATS” to take a close look at the credentials, life experience, and education Judge Lesley Briones brings to the table. And after you’ve researched both candidates, the choice should be very clear, as to whether Judge Lesley Briones or William “Bill” McLeod would be the better Democratic nominee to face off against former Judge Clyde Raymond Leuchtag in the 2020 general election next fall.

Lesley García Mitchell Briones, a native Texan, developed a deep respect for the rule of law while growing up on the U.S.-Mexico border. Bilingual and bicultural, she is the daughter of teachers, who taught her the importance of education, hard work, and serving others—values that define her.

Judge Briones left her hometown of Laredo to attend Harvard University. After graduating from Harvard with honors, she returned to the border to serve as an 8th and 10th-grade teacher at two of the lowest income public schools in the country. Witnessing the injustices her students faced deepened Lesley’s desire to fight for equal rights and influenced her decision to become a lawyer. She attended Yale Law School, where she led the Latino Law Students’ public service initiatives and provided pro-bono assistance to victims of domestic abuse and juvenile offenders.

Upon graduating from Yale Law School, Lesley returned to Texas to practice law at Vinson & Elkins LLP. She then served as the General Counsel and Chief Operating Officer of the Laura & John Arnold Foundation, a major philanthropic nonprofit. There, she led the legal and business operations of the organization, helping to build it from a small Houston startup to a team of more than 75 individuals across the country. Lesley is proud to have been part of a team whose mission is maximizing opportunity and minimizing injustice and to have helped grant over a billion dollars toward that goal.
