Ignorance of the Law is Not an Acceptable Excuse In the Case of Councilwoman Tarsha Jackson and Her Ineligibility


The new City of Houston Attorney Arturo G. Michel (above far left) was appointed by Mayor Sylvester Turner (second from left) back in December of 2020. In case you don’t know, the City of Houston Attorney is the person who should now be strongly compelled by Houston City Council District B voters and former candidates to look into how an “INELIGIBLE PERSON” based on Sec. 43.130 of the Texas Local Government Code which says, “A resident of an area annexed for limited purposes is not eligible to be a candidate for or to be elected to a municipal office,” was sworn-in to serve as a councilmember when she was in fact ineligible to run for the District B Council seat from the get-go! Residents and former candidates who ran for Houston City Council District B should call (832)393-6491 to reach the City of Houston’s Legal Department. If that does not work, the next best thing to do is for us to call on Harris County District Attorney Kim Ogg’s Office (above far right) to do something about this matter. Why? Well, if you remember, a few weeks ago, D.A. Kim Ogg said, “Our democracy depends on keeping our elected officials safe from coercion and our elections free from illegal manipulation,” back on December 11, 2020, when she announced the indictments of “WHISTLEBLOWER” Damien Thaddeus Jones, Natasha Demming, and Richard Bonton. That being said, our fair-minded, non-biased District Attorney also stated that those three indicted individuals crossed the line from dirty politics to criminal activity and that they should pay the price. With that being said, if City Attorney Arturo G. Michel does not address the fact that the City of Houston has sworn-in and seated an “INELIGIBLE” Council Member in the situation regarding Councilwoman Tarsha Jackson – I am hopeful that D.A. Kim Ogg will hold true to her words and make sure that all of the person(s) responsible for this clear and undeniable violation of the Texas Local Government Code is held to account on the matter of Councilwoman Tarsha Jackson and her residency issue. So, Mayor Sylvester Turner and the other Houston City Council Members should not be allowed to simply look the other way – or say that there’s nothing to see here – because that’s a bold-faced lie.

The issue of whether Councilwoman Tarsha Jackson is eligible to serve as the Houston City Council District B Council Member is really an open and closed matter – she’s not eligible!!! And to prove this, I have provided a copy of Councilwoman Tarsha Jackson’s voter registration card below. Do you see the words “HOUSTON LPA” that I highlighted with a red circle in the lower right-hand corner of the screenshot I’ve below? Well, the words “HOUSTON LPA” stands for “Limited-Purpose Annexation” and because Councilwoman Tarsha Jackson’s home address listed on her application (922 Sawgrass Ridge Lane) is located inside of an area designated as a – “Limited-Purpose Annexation” she was never eligible to even run for the Houston City Council District B seat in the first place.

Councilwoman Tarsha Jackson Was Never Eligible to Even Run for the District B Council Seat in the First Place

Let’s get this straight, all any person or person(s) living at the (922 Sawgrass Ridge Lane) is allowed to do under state law is vote for their District B Council Member – they are not allowed to run as a District B Council Member themselves. So, I am going to say this one more time, newly elected Councilwoman Tarsha Jackson, by state law was never eligible to run for the Houston City Council District B seat. Look, Sec. 43.130 of the Texas Local Government Code says, “A resident of an area annexed for limited purposes is not eligible to be a candidate for or to be elected to a municipal office.” So, as it stands right now, the City of Houston, has sworn-in and a seated a councilwoman who is ineligible by law, Sec. 43.130 of the Texas Local Government Code, to serve in the position. 

HOW ANNEXATION WORKS 

From what I understand, from reading published reports, “Since 1995, a new kind of land designation has been cropping up all along Houston's outskirts: the LPA, or limited-purpose annexation. It's a way for the city to collect sales tax in small, usually commercial, portions of unincorporated areas without formally annexing them or providing them with city services.” 

VOTER FRAUD IN DISTRICT B 

In case you don’t know, “VOTER FRAUD” can happen in an election when votes are depressed. And in the case of the District B fiasco involving Councilwoman Tarsha Jackson’s residency -- by having an ineligible candidate on the ballot back on Tuesday, November 5, 2019, the votes received by all of the other candidates in the District B race got depressed in my opinion. How? Well, all of the other candidates in the District B race back on Tuesday, November 5, 2019, had their votes depressed because many of the 3,322 votes she (Tarsha Jackson) received could have conceivably been garnered by another candidate who was present on the ballot “LEGALLY” at the time. Thus, by having a “FRAUDULENT CANDIDATE” on the ballot, the results of the Houston City Council District B race were skewed in a sense. In other words, Tarsha Jackson being allowed to “ILLEGALLY” run for the Houston City Council District B race was a form of voter fraud. And like D.A. Kim Ogg has stated, someone needs to pay a price! 

VOTER SUPPRESSION OCCURRED 

The people living inside the boundaries of Houston City Council District B deserve much better than what they are getting right now. These people have suffered enough. The people who voted for “LEGITIMATE CANDIDATES” in the Houston City Council District B race back on Tuesday, November 5, 2019, had their votes suppressed in my opinion. How were their votes suppressed? Well, by having a “FRAUDULENT CANDIDATE” on the ballot who garnered 3,322 votes or 20.85% of the vote – the people casting their votes for other candidates had the power of their vote minimized. Meaning, if the “INELIGIBLE CANDIDATE” had not been on the ballot, the overall potential vote numbers and percentages of every other candidate present on the ballot could have conceivably held a much greater value – thus producing a totally different outcome in the District B race back on Tuesday, November 5, 2020 – so Tarsha Jackson’s “ILLEGAL PRESENSE” on the ballot screwed up the entire District B race from the get-go in my opinion! 

DISTRICT B CANDIDATES GOT ROBBED 

I am not going to mince words here -- every candidate not named “TARSHA JACKSON” got robbed back on Tuesday, November 5, 2019, in the Houston City Council District B race. How? Well, by having an “INELIGIBLE CANDIDATE” on the ballot, the potential for “LEGAL CANDIDATES” to win over voters who unwittingly cast their votes for Tarsha Jackson, who was “NOT ELIGIBLE” to run for the Houston City Council District B seat got hampered. So, in essence, Alice Kirkmon, Ben White, Jr., Karen “KKC Kossie-Chernyshev, Robin J. Anderson, Broderick F. Butler, Alvin D. Byrd, Cynthia Bailey, Prince E.W. Bryant II, Karisma D. Gillam, Kenneth Perkins, Renee Jefferson Smith, Huey German-Wilson, and Alyson Quintana should all be pretty pissed off right about now. Why? Well, because they all got robbed of their legitimate shot to serve as the Houston City Council District B Council Member, because of the presence of a “FRAUDULENT CANDIDATE” garnering votes that could have conceivably been cast for one of them. And for all of you who don’t know, the word fraudulent simply means that something is obtained, or done involving deception, especially criminal deception. How did deception occur? Well, I am pretty sure that the voters who cast their vote for Tarsha Jackson back on Tuesday, November 5, 2019, were not aware that they were casting their vote for a candidate who was “NOT ELIGIBLE” to “LEGALLY” hold a municipal office in District B – based on Sec. 43.130 of the Texas Local Government Code.

Well, you can start by calling the City Attorney’s Office and ask him to look into this matter. The City of Houston’s Legal Department is located at 900 Bagby Street in Houston, Texas 77002. December 3, 2020 -- Mayor Sylvester Turner has selected a familiar name and a well-respected attorney to join the administration as the City’s chief legal counsel and advisor. 

The mayor announced Thursday that Arturo G. Michel is returning to government as City Attorney for the City of Houston. Michel previously served as City Attorney from 2004 – 2010. He is currently a partner at Husch Blackwell LLP. 

Before and after his public service, Arturo enjoyed a long and distinguished career in private practice, focusing on public governance, litigation, labor, elections, K-12 and higher education, contracts, and procurement. From 1986 to the present, except for his service as City Attorney, Arturo has represented school districts and other educational entities such as charter schools, private schools, state regional educational service centers, community colleges, and other colleges and universities. 

“Arturo has an extensive amount of experience in the public and private sectors. He is a leader in training for public governing bodies in ethics, open government, and contracting and procurement. He is an outstanding lawyer who will be an asset to my administration and will work in the best interest of all Houstonians,” said Mayor Turner. 

Michel is a Northwestern University graduate and earned his Juris Doctorate at the University of Michigan. Michel's professional affiliations include membership in the Texas Municipal League, State Bar of Texas School Law Section, and theTexas Council of School Attorneys. He served as president of both the Texas Association of Community College Attorneys (TACCA) and the Hispanic Bar Association of Houston and is a past recipient of the Mexican-American Legal Defense and Educational Fund of Attorney of the Year award. 

"I am honored to have the confidence of Mayor Turner.," said Michel. "I am excited to become the City Attorney at this crucial period for our city and our country as a whole. This will be both a challenging and rewarding opportunity to serve the Houston community." 

Michel will replace Ronald C. Lewis, who Mayor Turner appointed city attorney shortly after taking office in 2016. Lewis has resigned after accepting a new opportunity. He will remain with the City through the end of December.

I would have you to know that not everyone who has been accused of a crime or enters a guilty plea in connection with a crime is guilty of the crime they're accused of committing. Neither is everyone who goes to trial to fight charges that are leveled against them and get's convicted are guilty. Look, over the years, some very bad things have happened to people of color in our criminal justice system. So to this end, please understand, that during my career, I’ve gone into the Harris County Jail and Texas prisons on numerous occasions (on secret assignments) working in conjunction with the owner of one of the largest locally owned private security, and investigations firms. The man who was funding my investigations back then (who mysteriously died) also was the godfather of one of my sons, and the backer of one of my publications. That being said, I can straight-faced assure you that I’ve seen some of the injustices that are occurring in the Texas penal system up close and personal. While on the inside, I interviewed (face-to-face) some of the hardest criminals you can imagine for my research. I also discovered first-hand that many of the people who should be locked up are walking around free, and not all of those who are locked behind bars are guilty of the crimes that they, in some cases pleaded guilty to – for whatever reason. So, let me assure you that I know a criminal when I see one. And we have a handful of local elected officials who are straight-criminals and must be stopped!!!

PEOPLE OVER POLITICS

Based on my direct observations over the years, I can attest to the fact that our current criminal justice system is more about “HAVE’S AND HAVE NOT’S” to a greater degree than most people realize.  That being said, sure, in some cases, the skin color of the person being accused of a crime plays a role in who gets indicted and eventually convicted of crimes and those who go free. However, at the end of the day, from observing the system from the inside, and out; having money, good legal representation and access to influential people are unfortunately key determining factors when it comes to who will spend the rest of their life walking around with an “X” on their back and who doesn’t. So, to this end, we must endeavor to change our criminal justice system and political landscape by “TAKING POLITICS OUT” of the way our judges are selected in the Lone Star State – that’s very important to me! Have you ever taken a moment to look at all of the people who have been wrongfully convicted of crimes?
